Gibson's case

The bookies odds of teams going up via the playoffs were:
Leeds 15/8
Aston Villa 9/4
West Brom 10/3
Derby County 9/2

The implied probability therefore being 32.5%, 28.8%, 21.5% and 17% respectively. Given Middlesbrough had a weaker squad than us (hence finishing lower in the league), their odds of going up would have been lower, but we'll stick with 17% for now.

In their last season in the PL, they made a profit of £11.5m, so it would be reasonable to assume they would achieve a similar figure if they had gone up again. Instead, they posted a £30.7m loss. But, don't forget this was a Covid impacted season, so their losses were about £5m lower than they otherwise would have been.

This means there was a net impact on Gibson's bank balance of £37.2m. With odds of less than 17% (according to the bookies) the maximum he should be entitled to is £6.3m.

However, with Derby out of the picture, other teams would be fancying themselves in the run-in, not least Bristol City who we beat and pretty much ended their hopes of reaching the playoffs. Forest and Swansea weren't too far behind either. At the very least, this would have halved the chances of Boro placing 6th at the end of the 18/19 season. This means £3.15m is the absolute maximum to be awarded.

 

That other fella's case

Wycombe claim we should have had the points deduction applied last season. For this to have happened, the deduction must have been implemented in a timely manner, well before the end of the 20/21 season. With nothing to play for on the final day, Derby would have almost certainly lost to Sheffield Wednesday. 1% of £6m (£60k) to be handed out here.

are the EFL insisting that Gibson follows their rules as defined below when Gibson first tried it on or have I missed the tribunal as per the regulations

ELF V Middlesborough Tribunal 

13. It is accepted b both MFC and DCFC that it remains permissible for MFC to bring a separate claim by way of arbitration for compensation from DCFC. The EFL regulations constitute a multi-party agreement between (among others) the EFL and the Clubs. If MFC are able to bring a good claim for breech of Regulations by DCFC the effect of which has caused the loss, they can bring such a claim and no estopple will arise as a result of the Disciplinary Commission decision

Sorry, I don’t understand how the EFL can legally stop an entity from exiting administration. If I was a creditor of the club I’d be furious.

Surely theres virtually no chance whatsoever that Middlesborough or Wycome would win a case against Derby as it was the EFL who decided what actions were taken in retrospect to any breaches, so their gripe should clearly be with them if they have a problem? Don't get it at all.

So he's just trying to exploit us now we are in administration that's pretty sad if he was so bothered he would have done it at the time he's waited and waited to exploit us when we are in serious trouble

I am reading that as Q alleging the EFL are breaching their own rules?  Although it's a terribly put together sentence.

DET report says Ashley frustrated  but will not bid until the Boro. Wycombe so called claims have been resolved.

i don’t think The admin team have the expertise to win or the  willingness to be able to do that. And do they have funds to get legal help?

it seems like  Ashley is trying to help Boro and Wycombe get a cash settlement, and then he still won’t  bid anyway. Is he a  mate of Gibson?
