It will be a very serious matter though for Derby if he keeps this up.

That's a good point - as the EFL didn't actually charge us with financial irregluarities (just agreed a compromise punishment), it may work in our favour.....

So can we sue Reading for the lost 6 points last season due to their massive overspending then ? 
can we sue Birmingham for the points they gained by being over spent then? In that season 

we know QPR completely destroyed the regulations when we lost in the play off final so obviously we can destroy them as well 

there is no point mentioning Aston Villa as they haven’t been charged with anything 

Middlesbrough - What a joke - if they were good enough they would have got more points to lose against leeds 

Maybe we should not have bothered to get a draw in that game at Brighton which allowed Middlesbrough to get automatic promotion a few seasons ago. - on current behaviours you would seriously rest a lot of players to affect other clubs fortunes then again maybe that’s exactly what has been happening?

I for one hope Middlesbrough win. The floodgates will then be open for every team that has ever fallen foul of an FFP breaking team.

We are owed at least two full seasons of PL earnings plus 4 seasons of parachute payments after we lost to QPR and Villa. And that is if we got relegated straight away.

So Boro win £45m and we win a least £200m and probably far more.

 

I am stunned that Gibson thinks this claim has any legs. Talk about opening a can of worms. It’ll just make the EFL look even more farcical, if that’s possible.

Derby could sue other clubs but there’s no one in charge of Derby to do this. Maybe administrators wouldn’t want a long drawn out process doing this. In theory though surely clubs can sue each other even though it should surely be the EFL facing any action. Middlesbrough’s claim seems ridiculous but imagine if they win?

It doesn’t matter if it’s got legs but it will take time up stopping the takeover!

So us as a team with (slightly) more points didnt get promoted but he is saying if they had finished 6th they would have? During that season they drew twice with Leeds (0-0 and 1-1) and lost 3-0 twice to Villa so he is saying they would have beaten Villa at Wembley? How would that ever stick?  If it wasnt so worrying it would be hysterically funny

In order to make a claim papers have to be served on an individual or entity - you can’t just sue ‘Derby County’. The legal entity that is Derby County is one of the limited companies that is currently in Administration. If the claim was valid the administrator would not be selling as a going concern, he’d be looking to sell the assets (including the EFL golden share) to a NewCo in order to disenfranchise the claim.

This does not appear to be the pathway we are on so this is just water muddying.

in 2017/18 all four teams who finished above Middleborough had recently cheated in some way

It’s interesting but not relevant to the Derby takeover which might be delayed if a prospective  new owner doesn’t wish to take all this uncertainty on .
