"...Kirchner has communicated several different reasons for the lack of payment to employees over the last month. In a June 2 email he sent to the entire company, which Insider obtained, Kirchner described the situation as "an operational error with our corporate banking and investment practices."

"We have broken your trust in the company as well as our leadership group. I cannot say sorry enough," he wrote. "As a company commercially we have never been in a better position."

In that email, Kirchner said the problem has been fixed and the employees would be paid Friday June 3 or early the following week. Employees' financial records show they were not paid at that time.

On June 9, Kirchner told staff that the funds for their payment were available but the company had been terminated by its payroll processing company ADP, according to screenshots obtained by Insider.

"This has left us in a difficult situation as we scramble to get another provider online," he wrote on Slack. In the same message, Kirchner said he was travelling completing a deal that solidifies the future of our company." He went on to warn the staff not to talk to the media.

"Once a new payroll provider comes online we will process the payrolls immediately and sequentially," Kirchner's Slack message read.

In the emailed statement to Insider, Kirchner said: "The company's recent payroll issues resulted from the company's inability to timely liquidate funds from an otherwise attractive investment vehicle in order to make recent payroll and not from any funding shortfall. As a result of the company's failure to make payroll, our payroll processor terminated its relationship with the company, further complicating our efforts to restore payroll. The funds needed to make payroll have now been liquidated and we have engaged a new payroll processor," he said, adding that payroll would be caught up "in the coming days."
