I wasn’t upset at reading all that and not surprised either - how can the EFL board sit there and not resign immediately - threatened by a member in Middlesbrough to be sued for apparently not doing their job so what do the EFL do - please don’t sue us you should sue Derby a fellow member club who they are supposed to be looking after and the EFL won’t stand in your way and they will help it happen even if it means liquidation for Derby but don’t sue us the EFL - absolute disgrace!
The EFL can make this stop right now and those politicians should be going right for jugular as Derby county have been set up to be humiliated and probably liquidated by deliberate actions of the governing body and the Middlesbrough parasite.
There simply must be legal action against these individuals for their conduct.

Derby County will continue in some form or another and in some league or another. That's the only thing I'm clinging to.

Just to reflect, isn't it amazing what wonderful fans we have. From the EFL sitting with their smug arms folded they now, due to fan power and action, have been forced into a statement of defence and have had their despicable behaviour dragged through Parliament no less. Even the parasites have come out of the woodwork.
Well done all.

derbydaz22 reacted to Day in The Football Creditor rule is explicit, simple, and solves all of Derby's issues
Three parties have made offers, any one of which would allow the club to exit administration with a substantial payment to creditors.
These offers need clarity, that the claim by Boro and the potential claim by Wycombe do not qualify as Football Creditors.
The football creditor rule is not defined in the EFL regulations, it is part of the Articles of Association of the Football League Limited, of which all clubs are minority shareholders (the golden share).
The football creditor rule is in Article 48, which clearly defines what constitutes a football creditor, copied below from Companies House.
The rule clearly states that it is to cover payments of "debts due". How possibly, can an unproven, unquantified claim such as Boro's be consider a debt due?
If the EFL is suggesting that any claim by a football club or employee, which is unproven, should be classified as a football creditor it would create mayhem. And, bona fide football creditors with debts due, and other preferential and unsecured creditors would lose out as a result.
The EFL can't have this both ways. If they choose to say Article 48 does not qualify Boro's claim as a football creditor the EFL are suggesting they might be sued by Boro.
However, if they choose to say that Article 48 should be interpreted (which is a wild stretch) in a way that Boro should be classed as a football creditor then it is almost certain that the EFL would be sued by the Administrators and the creditors including genuine football creditors, and HMRC for their easily quantified losses.
The EFL also risk being sued under section 994 of the companies act for acting prejudicially against the interests of a minority shareholder of the football league ie. DCFC.
We need to apply pressure on the EFL to get off the fence, see that their actions alone are preventing the Administrators from getting a deal agreed.
Article 48 says that Boro's claim cannot be a football creditor and the EFL must state that and stop this nonesense.
"48 FOOTBALL CREDITORS
48.1 Where a Member Club defaults in making any payment due to any of the following persons,
the Member Club ('Defaulting Club') shall be subject to such penalty as the Board may decide

Great Post and your point about integrity is spot on. We still have to play Fulham, Bournemouth, Forest and Middlesbrough.
Are Stoke and WBA going to be happy if we field the under 23s (if we're lucky, it might be under 18s) and lose heavily when we had such good results against them with a squad the EFL is forcing us to sell? I hope they sue the bloody arses off them!

If and its a big if he goes a lot of the transfer fee may keep us going to the end of the season. So proud of the team and support today. We outsung the United fans literally from the start. Sending emails to EFL is useless.
But ringing during office hours blocks the phonelines. Every call has to be answered and takes up the time of a member of staff and occupies a line that other staff or customers might be needing. It's very disruptive.
I think we could be keeping EFL, Middlesbrough and Wycombe quite busy for a few weeks if we all get stuck into this.
-

My thinking is to contact the EFL and request clarification on a single point:
Why is the EFL insistent on DCFC settling an unsubstantiated and unproven claim made by Middlesborough FC, as a pre condition to new ownership approval?

derbydaz22 reacted to Zag zig in How are you feeling now? @14/1/22
Resigned to the view, the EFL as incompetent as a governing body that they are, will do very little to help our cause now.
So until we accept whatever their whim is, they will seek to punish us. Too many people within the EFL want to weaken our position either for financial gain (Boro/Wycombe aside) by picking up cheap players or vested interests to see us crumble.
If by some footballing miracle we stay up this season, they would only seek to find some manner to punish us next season under new ownership, strict business plan, further points deduction you name it, because others vested interests want us to remain weak and those voices are being heard in the EFL corridors, more than our own.
The governing body are doing nothing to protect us, merely listen to others that wish to see us fail.
Duck the lot of them. Getting ready to support our team, we are the future of Derby in whatever guise.

Quantuma would expect the EFL to remain neutral, not use the claims as leverage against the club. They are essentially preventing the claims being dealt with in accordance with their own ducking rules!!!!
Wake up!!!!

Oh give it a rest. They aren't new to this administration game.
The EFL are going 'against statute' how could the Admin plan for that? How could they accept that just another creditor claim be treated as 'football creditors' because they are football clubs? As has been said when we've given into those clubs without being able to contest their claim, who next. Which other clubs would like to take a financial pop at us while we're in administration and can't fight back!?!
-
derbydaz22 reacted to Sparkle in The Administration Thread
Leeds broke the finance rules as well but they haven’t been charged yet and whilst it is a different subject why don’t the EFL charge the clubs who are in the premiership for when they return to the EFL - it shouldn’t matter that they are currently in the premiership

derbydaz22 reacted to Ramleicester in The Administration Thread
So the unspecified footballing claims which we assume are from Middlesbrough and Wycombe are delaying the sale.
The EFL will not tell those two clubs to back off without some form of process (long winded) being completed.
So the likelihood is that no buyer is likely to WANT to be named as a preferred bidder or CAN be named as a preferred bidder as the risk for any buyer is perceived as too big, mainly because of the uncertainty on the size of the claims.
Hence the EFL asks for what the plans are to fund the club for the rest of the season.
Solution:
The Administrators should insist the Governing body ie. The EFL bring the footballing parties (Middlesbrough,Wycombe and DCFC) together VERY quickly to agree a possible maximum liability. Not to argue the merits of the case but to mutually agree a range of liability from £0 to a max figure. This would then allow bidders for the club to fully assess the risk and move forward or bail out.
Without something like that the situation will be stuck in the circle of doubt until the money runs out and the club folds.
The failure of the Administrators to look at this sort of strategy is odd given their responsibilities.

The EFL have destroyed the integrity of the division. Whether it’s:
- The EFL force us into relegation by restricting our squad.
- we liquidate the club
They have set a chain of events in motion.
This season all results against our team can be bought into question by any club, as EFL are forcing our club to put out an increasingly depleted team.
They have also opened the door to legal challenges when clubs don’t like final standings.
The division is dead in the water!

I’ve had enough, I’ve sat silently and patiently, foolishly hoping after the points deduction that this was a clean slate.
It’s clear that the EFL have a vendetta against this club and this latest move to block the preferred bidder needs highlighting and discussing from the highest media platforms and people of influence across the country.
As a fan base, chanting in the stadium simply isn’t enough anymore. We need to put real, sustained pressure on the EFL in the form of media exposure and noise.
Small steps lead to big things, the future of our football club is at stake, let’s not let it die without a fight!
Ive emailed just about every news outlet there is. If you have any positive action you’ve done, post below so we can keep track and build momentum.

I've considered lodging a claim for damages against Steve Gibson's hair.
It has caused me so much distress and anguish that I can barely function.
Had it not been for Steve Gibson's hair I would probably have had a high flying career as an executive of innovation leading multinational companies.
The fact the Steve Gibson's hair existed throughout my life from adolescents to middle age has damaged my mental health and financial position to the tune of what I estimate to ge £45 million in damages and lost earnings.
I expect the EFL to fully support my claims and as a class action, I appeal to everyone who has had their life ruined by Steve Gibson's hair to come forward.

If you told me the EFL were planning on hiring Sepp Blatter as a consultant while making all teams in red start with and extra 10 points I wouldn’t dismiss it.

You mean the Forest who are currently Cat 1?
We certainly wouldn't have recruited Plange if we weren't Cat 1. How many of our own would have chosen Forest, Leicester, Villa, etc of we were only Cat 2 instead... Cat 1 is a must in our position. The question would be how much funding to put in whilst still retaining that status.
