    By shunting loans around I mean transferring the benefit to someone else. So ceasing to be the lender by selling the loan. Dell doubtless has a web of trusts and partially owned companies and if he really needed to he could work out how to sidestep the rules without being too wide. Look I don’t think ownership by Dell is a likely option but we’ve no reason to rule it out yet

    Some are saying that Dell were involved in the EFl negotiations. The club statement indicates that Dell have lent more as things have got tight (did they take out Gabay)? 
     
    We know from his clumsy attempts to sell the club (Samuelson, Alonso) that Mel has no corporate finance acumen. He has no restructuring experience either. Dell is packed full of aggressive clever MBAs who have been hardened in the tough world of US M&A and restructuring. It’s no contest. 
     
    we don’t know how much Dell is owed, but they are probably the economic owners of the club. If they have been involved with the EFl then either they are really worried about losses, or they are focused on making a killing by owning or selling the club. 
     
    The reason this matters is that Dell’s interests - like those of the club - are certainly best served by avoiding administration. They are probably in the driving seat. We should not regard administration as an inevitability just yet

    Question is whether MSD, the club and a potential purchaser would be able to persuade a court to extend the two week ‘notice of intention’ period. It may be possible to extend if a takeover is imminent. 
     
    If the party who walked away last week was at an advanced stage of due diligence, they might be able to move quite quickly

    Everything Mel said indicates he regards administration as inevitable. In fact he and ED spoke as though we are already in administration. 
    I think the position is that we have 2 weeks to avoid formal administration. This probably means finding a buyer and doing a deal with Cocu’s team and HMRC within that period (it seems they are the main unsecured creditors apart from football creditors). 
     
    Perhaps Mel knows that it’s now impossible to avoid administration eg because MSD have pulled the plug. Hope not

    MSD might lend more to fund salaries. Also I think the administrator can borrow to fund company costs if it makes sense to do that, and if he does the lender gets a prior claim
    if players contracts are not adopted, yes I’d think those players will become free agents. They are free of contract 
    I don’t think the suspended 3 point penalty would apply where contracts are not adopted, so long as salaries are paid to termination. But not at all sure 
    I’d guess the requirement to pay football debts in full applies to football debts as they fall due. In other words, you could still pay in instalments so long as you keep them current.

    Yes exactly. This is why Mel said that for things to move forward,  he needs to be out of  the picture. Gibson has his testicles in a vice

    My personal view for what it's worth is he sounded deflated towards the end of the interview. A beaten man.
    Despite a lack of raw emotion shown on air, I genuinely think Friday would have hurt him massively as this wouldn't have been anywhere in his plans.
    I understand this will not be any comfort to any of the staff that will lose their jobs, or creditors unpaid who my thoughts are with right now as they face an extremely tough week ahead.
    Tomorrow I will be opening a jobs board on the forum, if any of you have a business or hear of vacancies in the local area please post them.
    Also if you know anyone that has/will be lose their job through this process, give them a heads up.
    Saturday showed what an incredible fan base we have when we come together, let's help try and make the impact as minimal as possible. 🐏

    Those slamming Mel should pause for a moment to think about his intentions.
    I do not - for a minute - think he's intended to run the club down.
    He has spent millions, not to run the club into debt, but to chase the dream. We all supported that chase.
    Even though he's managed things badly, which he admits, I do believe that he genuinely thinks the only way he can get new owners in is to put the club into administration.
    I'm very far from happy about that, actually been crying about it, but I think it's sincere on his part.

    This could obviously be very significant. The club may reckon that notice of intention is what is needed to get HMRC properly to the table to resolve this claim. HMRC’s position not strong when dealing with football clubs because of the football creditor rules
