BPV reacted to WestKentRam in EFL Verdict
From the statement on the DCFC website of 17th Jan 2020 it sounds as though this is the case, although not 100% crystal clear, ie the club wouldn't have done certain business if they hadn't had the amortisation policy previously approved by the EFL. https://www.dcfc.co.uk/news/2020/01/club-statement-17th-january-2020
'Had the EFL not given the green light in writing in respect of both charges, the Club would have reacted accordingly. The Club cannot re-trace the steps of the actions it legitimately took in good faith as a result of EFL approval of both matters.'
Does 're-trace the steps of the actions it legitimately took in good faith' mean submission of accounts, or future spending undertaken?
This seems to be the crux of it. If it's just we chose that method after reviewing the accounts to make them fit FFP/P&S after the event then we are in trouble. If it was actually approved by the EFL and effectively we spent more because of this thinking the books would balance, then it would seem a valid case for appeal.

But does it though? The accounts were signed off. There was no problem. If there was, I am sure there are many of things the club wouldn't have done. You cannot say it's fine and then a year later say actually no it's not. As much as I question the way the club has been run, this is EFL incompetence.

Actually it's like the police telling you it's ok that your speedo is 10mph out and then the police fining you for it a year later.

This has been my argument all along, we wouldnt have done some of our business if the EFL hadnt signed off the Amortisation policy.
We wouldnt have signed Bielik, Jozwiak and I imagine Rooney wouldnt have been here.
It's like being granted planning permission for an extension and then being hit with a punishment because the planners realise your house is now bigger than theirs and everyone elses.
We need to wake up and quick, the EFL are literally doing anything and everything to destroy our football club. This is a battle of egos between Parry and Morris and our club and the fans are collateral damage.

Still don’t get how:
- EFL rules don’t state the method of amortisation to be used
- we submit accounts using a legitimate accounting method which the EFL accept
- we submit 2 more years accounts using the same method which the EFL accept
- Keiran ‘finance expert in his own head’ Maguire tells the EFL that we’re doing something different to all the other teams
-EFL charge us over multiple issues and lose
- EFL appeal a small part of the charges and win but now threaten to relegate us if they decide to appeal again.
Surely their appeal was only against the fact that we’d not been clear enough in telling the EFL accountants that we’d used a different accounting technique. The fact that the latest appeal has decided we should have been fined for the issue rather than given a good telling off doesn’t legitimately leave scope for a points deduction for last season - so relegation shouldn’t even be a consideration at this stage.
This is a vindictive statement meant to cause as much trouble as possible - at a time when all clubs are in dire straits due to COVID. Appeals from either side simply drag out this farcical process and cause more damage - the EFL need to remember they have a duty to protect all clubs and not continue to attack us just because their chief exec is best mates with a nasty little man in a Middlesbrough - particularly when they have history of letting clubs with far larger FFP breaches off the hook……

What is the point of a Disciplinary Commission if the EFL will simply not accept their decisions? EFL is coming across as a totalitarian state.

BPV reacted to RadioactiveWaste in EFL Verdict
The EFL invested so much into "getting" DCFC that they now can't afford to be seen to "fail".

I just don't know what the EFL are hoping to achieve. Is FFP still about protecting clubs from going bust or is it just a set of rules with no purpose?
Dragging this out is stopping us getting the takeover that we desperately need. This could make us go bust, so where does this even relate to "sustainability" anymore?

It's bad for both Wycombe and Derby. The EFL are a disgusting organisation who have shown time and time again that they do not protect clubs.
Haven't we had enough punishment as it is, our name has been dragged through the mud. This case has been going on for years. It's appalling. And now they want more sanctions because we supposedly gained an unfair advantage with our accounting methods even though we haven't.
2 full seasons now of absolute chaos and it's still going on. What an absolute shambles.

BPV reacted to LazloW in EFL Verdict
The EFL could now just say ‘ok, we got what we wanted, a clear ruling that how DCFC did the accounting is wrong and the club have been punished. That’s an end to it’. That way they keep a big club in the Championship and save face. Not really sure what’s in it for them by relegating Derby and Sheff Wed (two of the biggest teams in the EFL) and keeping Wycombe up. An odd business decision.

You know, the more I think about it, the more bizarre it seems that the EFL are making and very openly broadcasting the fact they're making a separate fixture list based on a points deduction that hasn't happened. They've just invented a potential punishment that's different to the punishment that has actually been handed out and are going to publish a set of fixtures based on this imagined punishment, even though there's no suggestion that it's likely that it will actually be given.
What a weird organisation.

Clearly the efl are going to try and relegate us through the re submission of our accounts which, are no doubt, already calculated.
I can't see how we won't be in breach or we wouldnt have tried it on in the first place and submitted them in a different manner to every other team in the country.
I'm starting to think that league 1 in six weeks is inevitable and that a total reset and a fresh start is perhaps what's required,if nothing else but to get the efl permanently off our backs.
I just want to watch Derby play football,I'm sick of this.
-
BPV reacted to Steve Buckley’s Dog in EFL Verdict
The EFL will relegate us one way or another. The timing of the announcement tells you everything in my opinion. They lost but will do their level best to derail next season. Now we are in a position where we can’t really plan or attract players. Vindictive and unprofessional. I take it they appeal until they get the decision they want. What they should do is allow our recruitment team to sign whoever they want if they really want to punish us.
If Derby don’t announce that the accounts have been re-submitted and we are fine then I will be worried. They have had years to prepare them so surely should be in the post already.
What a load of crap football has become.

Nail and head @CBRammette. This is all about payback to Mel because he exposed the EFL’s total incompetence over the TV Rights deal and almost toppled them with the breakaway league suggestion. Football is broken thanks to the ignorant suits who run the game.

It does have the feel of an ungracious, face-saving statement to me.
The real story is we have been fined 100k. EFL basically turning that around to saying they have won and we now need to fall in line, kiss the ring, grovel a bit and give them what they want...or else..
-
BPV reacted to JfR in EFL Verdict
I know the stand-out part of the headlines around this is "could still be relegated", but realistically that isn't going to happen.
For that to be the case the EFL would have to appeal and the second panel would have to conclude that:
1. The financial penalty is either entirely inappropriate as a punishment or inappropriate as a lone punishment, and that sporting sanctions are necessary
2. The only acceptable sporting sanction appropriate as a punishment is a points deduction
3. The only acceptable period where this deduction could be applied is in the season just finished
and all of this would have to be done before the season starts. That is a lot to overturn when rulings can only be overturned if a clearly inaccurate decision has been made.
I truly believe the reason the EFL have been putting this one out there so much is because the actual punishment that the panel has decided on - a £100k fine and a resubmission of accounts - is quite embarrassing for them as a final punishment after years of proceedings and far more than £100k in legal fees, so they're hyping up what "could" happen to make it seem like a bigger win for them than it is.

I've already made a decent rant on the EFL, I don't think I've got the anger left as they've managed to drain all my emotions for football. Accountability zero. It's bitterness from people with a personal vendetta against the owner. Nothing to do with actual football. Political point scoring in the board rooms. I wonder who suffers from their endless stream of slop.

Problem is can any of you see an end to all of this off the pitch garbage? I am just so very fed up with anything Derby at the moment. I get Mel has totally pissed off the EFL, generally his gambles have imploded and The EFLs job is to uphold their rules whatever we think of the rules and EFL but the EFL seem absolutely hell bent on destroying Derby now. They know full well how the timing of this will damage us. How is this any way for a so called "professional body" to behave. It is now just vindictive and just seems very personal towards Mel which is not right.

Dreading the Euros ending and having to come back to DCFC. Between the club, the takeover and the EFL, my interest just isn't there.

How many more clubs are the EFL going to forcibly attempt to send into liquidation once they finally move on from us?
Their failings as an organisation have seen the end or became within a whisker of seeing the end of a handful already, there's no sign of of any conscience or sense of responsibility from them though.
They'd rather sacrifice an entire club with over 120 years of history to appease one or two playing crybaby on the assumption that we've somehow gained an advantage over them (an advantage that in reality we haven't. even. bloody. gained) and save face by constantly appealing until they get someone to tell them they're 'right'... but that's not enough, no, they then want to appeal and appeal and appeal until someone finally agrees to implement their ridiculously OTT punishment.
They've already cost us far more than anything our methods could possibly have cost anyone else.
Protecting your member clubs my arse. They don't even know the meaning of the word. Absolute ducking scum more akin to the mafia than a sporting body.

BPV reacted to JfR in EFL Verdict
The most annoying part about the EFL putting these statements out at this time of night is that you don't get the full picture at the time and start filling in the blanks. Hopefully the club will put out a statement early tomorrow that will provide a bit more insight into this issue, and hopefully the panel's findings will be published not too long after that. If the club can confirm that even with resubmitted accounts we stay within the FFP restrictions and if the panel were firm and clear with their findings then I'd start to feel pretty calm about the whole situation.

****** hell, how many times can the EFL appeal!!? they didn’t like the original decision, so they appealed, they’ve now got the appeal decision, they don’t like that so they’re now going to appeal the appeal!
This is absolute madness, do they just keep appealing until they get the answer they want!?
