    In third party, it is clearly written on behalf of Boro, EFL and WWFC(Couhig) , but signed from him. It’s appallingly written , in one sentence it references Steve and then Mr Gibson and is ultimately signed Stephen ? It is a terribly written “open letter” almost comedic. They are panicking.

    For me it’s blindingly obvious. The EFL has failed in its duty as a governing body.
    Mel Morris gambled, failed, and ran out of money. We might have soldiered on with him but Covid threw petrol on the glowing embers. 
     
    The EFL however have pursued clubs that breach FFP as if they were pariahs and cheats when in fact they were just clubs with funds trying to compete with the half dozen parachute clubs with so much money following their fall from the prem that they have budgets vastly different from other clubs in the league. FFP and P+S were never anything to do with fairness. 
     
    The EFL has been limp when selling rights to broadcasters which hasn’t helped the finances of the championship but has been antagonistic in the extreme towards anyone who has the temerity to question its competence.
    When it has been called on to show leadership it has vacillated, dithered, acted to preserve its own status and power rather than the clubs it is supposed to represent. It is riven with self interested groups and hasn’t an iota of sportsmanship in its rotting corpse. It’s lack of professionalism in presenting cases in dispute has at times been laughable, preferring to rely on power and pomposity rather than fact and reason. 
     
    In my opinion it needs disbanding forthwith.

    In a Nutshell, the EFL's position is ....if we make a decision on this to unblock the logjam, Boro will sue us instead of Derby.
    The extortion is quite simply that crude.

    -21 points, 5 transfer windows under embargo, £100k fine, administration, likely relegation. That’s all for Mel’s transgressions, and we’ve largely accepted that. The threat of liquidation due to spurious legal claims is totally separate to that. We can be rightly angered at Mel, and we are, for all the above, and STILL be angry with MFC, WW, and through complicity, the EFL, for the continued vendetta, and it IS a vendetta against the club.
    Our punishment, is unprecedented, and they’re still NOT happy. If that’s not vindictive and spiteful I don’t know what is. Pushing a fellow club into oblivion because you have a gripe at someone who’s no longer anywhere near the club. This is why children shouldn’t be allowed to own clubs. In fact I’m being unfair there, not even most children would behave in the way that pube-head and the ambulance chaser are. When an independent regulator is finally installed, the first thing they should do is kick this pair out of the game entirely. Football would be far better off without either of them.

    The embargo cannot be lifted until we have the money to get us through to the end of the season in the club's bank account.
    We cannot get that money in the club's bank account until we have a preferred bidder 
    We cannot announce a preferred bidder until the Boro and Wycombe claims are dealt with.
    We cannot agree terms with either club as that means the preferred bidders will walk away.
    We can only take the claims to court/arbitration if we have the funding to keep up going for several months.
    We can only get that funding if we announce a preferred bidder....

    Sat here in bits again. My dad is really really ill and his bad days seem to coincide with bad news Derby days. He is Derby through and through and I'm not sure he understands or is aware of the off the field stuff now but I know later watching those goals on Quest with him how he will light up as little else makes him do now. That is why we have to save our club. It is not about amortisation, stadium sales, law suits, points deductions, etc. it is about watching those goals with my dementia-ridden dad and seeing his happiness for a few minutes later knowing we're off the bottom. The wonder of dementia is he will have forgotten tomorrow so we can do it all again several times. So duck the EFL, Morris, Gibson and the nobody chancer from Wycombe. We are better people than all of you and how dare you threaten the existence of our Derby family.

    I think the admin have said what is going on. They cannot start getting a voluntary agreement with creditors until there is agreement with EFL on how Boro and Wycombe claims should be treated in the necessary creditors vote. It's not about who pays for the claims if they win.. that will be the new owners liability if it happens.
    But in any creditors vote each creditor has a weight according to the amount of money owed to them.  So admin team has to assess that. It will be very low weight given to Boro and Wycombe claims I guess because admin team has said the claims are of no merit and they are not football creditors anyway. 

    For some reason EFL do not agree with admin teams assessment. Ultimately EFL has to approve the transfer to new owners , and if they do not accept the validity of the creditor vote then we are at loggerheads.  In the meantime they are trying to bully us with threats, deliberately co-inciding with the end of January transfer window.

    Whilst I appreciate it will be likely treated with contempt - I have sent the following email to Mr Parry and Mr Birch - it will get us no further forward I’m sure - but at least I’ve got it off my chest!!!  And now I can get behind the team this afternoon.

    “Like many other Derby County fans - I gravely concerned by the current situation threatening my football club and I hope you are able to provide some clarity.  In a statement issued by our Administrators they state: 
    “The difficulty and currently, in our view, the last remaining significant obstacle is to deal with certain claims that are very much disputed but which we are being advised by the EFL cannot be currently compromised notwithstanding statute says otherwise.” 
    It is this paragraph which concerns me most. In essence it appears that the EFL Board is overriding statutory law in order to punish Derby County beyond what is fair and reasonable. I’d therefore like to ask the following:
    1. Is the statement made by the administrator’s of Derby County FC factually correct? 
    2. If so, can you confirm which body within the EFL has reached this conclusion?
    3. Can you provide confirmation that this body has full independence in so far as any member of the Board or its nominated sub-committee which maybe presiding over this matter is not conflicted by way of ownership / interest / contract / membership of or to any of the parties bringing claims against Derby County?
    4. Can you share the specific articles of law or other legally binding agreement that are being relied upon to override what might be considered statute. 
    5. Please provide evidence of how the EFL is acting impartially and has applied lessons learned from the sad demise of Bury FC in the handling of this particular matter. 
    6. Please provide evidence of how the EFL is working to protect the interest of the thousands of innocent football fans affected by this ongoing punishment of Derby County Football Club. 
    On this point, it should be made clear that Derby County is more than a name, more than a pawn in an egotistical, power play - it’s an important part of many peoples lives - it does a huge amount to support the community it serves. The majority of these fans are victims and are angered and frustrated at the prior owners handling of matters. 
    So my final ask, is please do not let the actions of the privileged few be an incentive to punish thousands of innocent victims. The mental anguish you are causing the thousands of people now needs to stop. You have a duty of care which extends beyond your fiduciary duty to the member clubs.

    Why is the EFL insistent on DCFC settling an unsubstantiated and unproven claim made by Middlesborough FC, as a pre condition to new ownership approval?

    So, if I understand this right Derby Mel Morris buying the ground wasn't illegal but didn't fit the law, Derby used an amortisation that wasn't  illegal but didn't fit the law too. We get punished for the second one(fined), just how duplicitous do the EFL want to be.
    Forgive me if I have this wrong.

    I wouldn't say "thrown out". After negotiations with the EFL, he agreed to drop his case if they charged us and they agreed that he could go after us for compensation if their charges stuck. This is explained in the LAP decision on Boro's Arbitration case where they tried to piggyback on the EFL's case against us. That's what delayed us getting our sanctions. 99% of the f'wits in Middlesbrough and Wycombe don't know this of course.

    In fairness, we’ve been punished for what isn’t in the rules - specifically a requirement that straight-line amortisation is the only accepted method.

    if we had won we would have got promoted and not them !!     They finished 2nd 80 points we finished 3rd 78 points.
    I remember quite clearly that it should not have been a corner from which they scored !! ?

    They are not answerable to me in anyway shape or form.
    You may think they are answerable to you, but they are not.
    Nothing pedantic about it, administrators are appointed to serve the best interests of the creditors, not the customers.

    Well actually the two times EFL tried to deduct points off us when Morris was in charge they failed both times. It was only when the admin team took over that they gave in without a fight.

    Your correct re Morris.   I still have absolutely no idea why he didn't clear liability and sell the club for a nominal fee to match the assets on the pitch, with a nominal payback of say 5 million a year for 6 years getting his final outlay back.  That could have been worth 25 million up front and 30 million over the next 6 years, or payment in full on any promotion.
