Before a judgment was made yes,but that’s why I think the date is interesting. They say proceedings commenced before administration.

im not saying I agree, or profess to be an expert!

You have to remember, the charge was that the amortisation was incorrect/misrepresented.. Not that we were in breach of ffp - that came much later when we were in admin.

  2. Tbh I think there's a lot of overreaction in this thread.

I don't think it's a surprise that the efl would deem the claims by mfc and WWFC as being football creditors.

Theres also no reason to think that the efl would (or even could?) change their insolvency policy. Particularly in a way that would be of detriment to their other members.

I suppose the real question is (and it would be interesting to know if there are other examples of this in non-sport setting) are regulations in a private league that restrict a way a member can conduct otherwise legal methods of exiting administration where the penalty of that is to be thrown out of competing in the industry. The league operates as a monopoly... There isn't a way Derby can really compete outside the FA/EFL framework. My gut feeling is that they probably can impose additional restrictions.

Absolutely agree. They aren’t saying they should be paid, just that if the claims are upheld by whatever method, then they would be classed as football creditors.

I agree by they that if should be football creditors, IF, and it’s a massive IF, the claims were valid.

one point I found interesting is that the statement says that the process commenced in January 2021, before the club went into administration. I think that’s a pertinent point.

Before we were even found guilty of anything I think. So by that measure any claim for any reason by a football club must be resolved regardless of merit.

Exactly. Efl still spinning it , like Parry did last week on sky , that they are waiting for admin to announce a Pb.

I think the missing line from the minutes sets out the admin position. Which is they were ready to announce a Pb once Efl acknowledge that Boro and Wycombe are not football creditors.

pure disingenuous spin from the efl. Actually that’s being polite.

Its always been like from the efl. People seem to think Derby never submitted accounts to the efl. I find this quite unlikely, I find it more likely that we never sent in accounts that the efl find acceptable.

  5. I'm starting to think that doing a deal with hmrc and 'dealing with boro, wycombe after' are incompatible approaches. Hmrc aren't going to like being told they can be paid £xm when a buyer is willing to be exposed to a higher loss from boro and Wycombe.

It does make me wonder whether boro or Wycombe have actually quantified their claim at all.

Our good friends in Bristol, part of the friendly football family of the efl..

The first thinking we have any sort of control about how administrators may run our club or get a buyer..

The second, our good friend Mr P thinking that us as fans that might lose our club... Might have the audacity to consider ourselves victims rather than villains (!)

These clowns (and others) do real football fans a disservice.

We are as a fanbase embarrassed that our old owner didn't pay the debts... However we aren't going to accept going out of business as either a price we have to pay to put the fear in other clubs' chairmen and we aren't going to start grovelling and feeling remorse for our old chairman who ran the club as he did when we are ultimately the club bottom of the league, never got promoted, with a team cobbled together with a real chance of going out of business.

    Just makes me unbelievably angry.

  7. Frankly this statement concerns me. I don't think it is surprising that the efl gave us an extension.

What concerns me is that all of the major hurdles are still there. Not sure why the stadium is a concern of the efl as it doesn't belong to Derby County Limited.. Unless its all horribly tied up somehow with the business? I thought they'd already agreed with hmrc so it begs the question what on earth Q have been doing.

I also suspect that due to the joint statement there could be agreement on comms too going forward.

  8. Yeah this has always been the case if the outcome to the creditors is less than efl rules.

Tbh I'm not really sure what it achieves apart from punishing supporters, making relegation likely again, distorting the competition and making a club less attractive to new owners...

The old owners will have ran off, the admins will have done what they can, so I'm not really sure what it achieves but I'm sure it makes some fans and chairmen of other clubs happy.

  9. When I was a very young child I thought I liked Manchester United because that was who you could watch on itv without cable or sky.

Dad promptly took me to Derby..

I've always regularly gone to see other clubs, even had season tickets... but I'm checking my phone for the Derby score throughout....

I find Middlesbroughs forum absolutely amazing, when I browse it.

So many posts wondering why Derby fans don’t blame Mel Morris for the position they are in.

I think they must be referring to a different Mel Morris to the one who was last seen fleeing his home after installing 24 hour security, who will never be welcome in the city of Derby ever again.

This and Bristol/Wycombe. They seem to think we all still support Mel Morris (no one does) and that or anger is misplaced at the efl and boro etc.

Our anger at them is their obstruction and refusal to help us out - it is out of fear that we are about to lose our club. Im not sure they realise that we are on the brink here.

Also for those fans of other clubs that think we haven't been punished enough... If it hasn't dawned on you, our old owner has washed his dirty hands of us and if we survive it looks like more points deductions and we'll be in league 1... Great punishment for the fans of the club. Losing our club would be a massive loss and represents more than a fair punishment.

  11. I'm unfortunately not so confident we'll beat liquidation..

As it stands the efl need to move from their position protecting WWFC and MFC which despite pressure politically, I think they'll need more of a stick to move their position. I don't believe the efl are capable of or even wish to resolve this themselves.

WWFC and MFC seem even more unlikely to change their position based on their statements this week.

I think the efl will end up giving us a 14day/21day extension to prove the club can complete its fixtures and forge a way forward.

I reckon court action is the likely the only way forward.

  12. The only thing I can think of is that the pb want the efl to assure them that they won’t be able to be sued by boro or Wycombe which the efl can’t guarantee.

I don’t understand why there needs to be an insistence on getting this sorted now as long as the pb understand they have to deal with Wycombe and Boris claims at arbitration.
