    The problem comes in the summer though when Lawrence, Ebosele etc leave and the new owner needs to build up the playing squad under a strict business plan.

    This absolutely, I struggle to understand how low balling an offer to save a few quid on purchase is sensible when in June we are going to lose potentially millions worth of assets for nothing. I dont think we even get compo for the kids if their contracts run down and they leave with no offer made by Derby. These players would likely sign on as soon as Derby are allowed to do so and then if they want to asset strip they can do so, and we then actually have assets for these owners to strip and start to get their money back.
    My fear is June comes and goes, we have a couple of players left, who may go because league 1. We are still under embargo and noone actually buys us because Derby are a club with zero assets but a shed load of liabilities. June comes, I think it's over. And it breaks my heart.

    Had a similar response to my email to which I have responded as follows, with Margaret Beckett again CC'd:
    Dear Mr Parry,
    You infer that bar Derby County, every club in the country adheres to straight line amortisation policies – this is simply not true and it’s staggering that you would suggest as much. In 2015/16 Aston Villa were relegated from the Premier League, which allows a P & S loss of £105 million over three years, which then tapers down to £39 million over three years in the EFL Championship. It was therefore in Villa’s interests to put as many costs into their 2015/16 accounts to be absorbed by their Premier League P & S limit. Villa achieved this by charging an extra £79.6 million as a cost in the expense for impairment of the stadium and players (labelled ‘intangible assets’ in their accounts). No investigation was deemed necessary and no sanctions applied. There are too many other instances to list so I simply offer this particular one to illustrate that where the juggling of player values is concerned, there is one rule for Derby and another for everyone else.

    If, as you claim, this amendment has been introduced ‘so there is no room for doubt’, does this not clearly infer there was doubt at the time the policy was in use? And given this has now been highlighted as a rather grey area, do you still maintain the sanctions applied are fair and fitting? Might I also ask what the EFL stance is on club’s selling their debts? Likewise, the pricing of players moving between clubs under the same ownership? The fact is that the EFL has spent over 2 years and no small amount of member club funds bringing Derby to task when a simple amendment, akin to that applied this week, could have been made as early as 2018 along with a request that Derby adopt a straight-line amortisation policy from thereon out.
    It is also worth pointing out that the EFL, who claim to have ‘several accounts monitoring practices in place’ was made aware of the fact Derby County were using the ERV amortisation policy in 2018, yet chose not to bring this up with the club itself until 2020 by which time the relevant P & S period had closed. Had you not delayed the process until the 3-year period had elapsed, Derby would have been in a position to address the P & S threshold breaches through player sales or other means. Waiting until 2020, when the EFL was itself under threat of litigation from Middlesbrough FC, meant that Derby were not afforded any opportunity to bring either their accounting practices or their FFP overspend into line. With these facts in mind, I ask you again, do you still maintain the sanctions applied to Derby are fair and fitting?

    Frankly, if the EFL is to retain even a shred of credibility, the sanctions applied to Derby County need to be reviewed immediately as the punishments far outweigh the ‘crime’. Failure to do so would result in the not unfair assumption that the current EFL board has brought the League into disrepute and that as such, those in question ought to be considering whether or not their positions remain tenable.

    The way I see it, this is absolutely NOT the time to be easing up on these clowns. Their actions this week yet again compromise the club's chances of survival in the Championship and as long as they continue to act in this fashion, we must keep boots firmly on their throats.

    Who cares about reality ? the EFL, Boro/WW don't seem to care about the reality of this situation or the reality that their claims are spurious ?
    If it helps put pressure on someone to actually do something then its an angle that should be pushed.

    Well done for getting MM into the fray.
    But now Rome burns whilst two titanic egos and a nasty US lawyer are locked in a PR battle. And you have terrified the EFl into hiding behind 20 lawyers and an unwieldy rule book 
     
    Forget the lengthy meetings. Gibson is intent on dragging Morris into a long set piece one to bully, humiliate and torture him publicly. It will achieve nothing. And Couhig will just sit there and excrete slime. You will be pushing it uphill 
     
    The litigation options are either Russian roulette or too complex. And Q has left them too late 
    But getting MM into the fray is the beginning of a solution. Now you need to put MASSIVE PRESSURE on him to indemnify the club against these claims. It’s not the only solution but it’s clean and can be done relatively quickly. 
     
    There are a lot of you. Please organise and focus yourselves

    I wonder how many clubs would have a claim against QPR, and for how much, if an EFL panel rules that we do in fact owe Middlesbrough cash and sets an incredibly dangerous precedent.
    Us? For half the supposed premiership windfall? The team they beat in the semi-final? Do they get a quarter? What about the team who finished seventh? Any team that can "prove" QPR's results against them had an effect on them - ie how did the relegated and nearly-relegated teams do against QPR? 
    Did QPR sign any players during that time that other clubs can prove they were pursuing? Have those players since been sold for a profit?
    What kind of total bill are we looking at here?
    Does the EFL specify some sort of time-limit on these claims in its rules? If not, why can't we pursue them now, or at whatever point we feel like it in the future?
    How do we formalise how we quantify the points loss to the "affected" teams? Is a £1million overspend equivalent to one unearned league point, for example? And are we just going to make that up on the hoof at an EFL hearing, or shouldn't we actually agree it between the clubs first?
    And do the points deductions get adjusted or is this some additional penalty on top of the one we thought we had all agreed?
    It's an absolute mess.

    You've just asked the question I was wondering.
    What did they base their 'football debts' ruling on? Surely they should quote the Rules that are applicable in our case? Then we could contest their decision?

    Everyone knows that the EFL are not fit for purpose but I am sure we cannot bring a case against them purely for incompetence.
    We are all talking about legal cases to rid ourselves of the claims by Boro and WW but can we go on the offensive against the EFL?
    Please can the experts on here give their opinions on whether there is a legal case against the EFL for:
    Not adequately monitoring their own FFP rules Not adhering to the ruling of their own appointed independent panel Not allowing an amortisation policy, allowed in law, and that isn't (wasn't) against their own rules Not applying their penalties (points deduction) at the appropriate time - leading to the Wycombe claim By ruling that unresolved claims should be treated as debts delaying the legal process of finding a buyer to exit administration By applying rules that, by their own admission, have not even been published Being the body responsible for governing the leagues but then allowing clubs to take actions against one another The cost of this is the possible liquidation of a founder member of the Leagues they are meant to represent. In addition, the club's status as a Championship club is threatened by their penalties, points deductions, transfer embargoes, delayed takeovers. Many employees of the club have lost their jobs. Local businesses have not had their debts repaid. And the club have been forced to sell players, including promising youngsters that were the future of the club. More players will be lost because the club is unable to re-sign them.

    I agree and on that basis isnt court the only option for Q. If the club is liquidated all creditors loose. Go to court, win against some dodgy claims and the path is clear for bidder(s). Do it and and do it quick.
    At the moment Boro and Wycombe are playing a waiting game which costs them zilch and could bring rich rewards. When we say see you in court, it's a very different game.

    I do like the idea of legal claims to use winnings to found a phoenix club if necessary. Calling all lawyers who are fans what precedent could we use? If we can find a way to all do it presumably thousands of small claims., even if unsuccessful would have to be dealt with? Need to start now with preemptive emails saying we are going to claim which is pretty much what they did

    I don't really listen to Talksport unless Simon Jordan is on. 
    He regularly makes me laugh out loud. He's amusing and annoying in equal measure, but as I have said previously it's all pretty tongue in cheek.
    He did say Rooney shouldn't have been given the job, but recently has been praising him. No argument to be had here.

    I'd be angry and disappointed if this is the case. The EFL are continuing to just choose which rules to apply and when.
    Its another striker who could be a 20-goal a year striker being let go.
    I'd be genuinely interested to know if this is with or without Rooney's blessing but of course it'll be twisted by the whole fact that he's still with us, albeit on loan.

    I would have driven Wayne to alderley edge after the way we finished last season and kicked him out of the car without stopping . I am ashamed to say I never saw his integrity and loyalty . I the last person to make me feel proud of our club was young Nigel ( Clough not Pearson)       I hope that when Wayne moves on we promote from within

    I have to agree, not many of us were trying to save Bury but at somepoint the cycle needs to broken and clubs need to come together to stop this kind of thing happening 
    Iv been amazed how ruthless some fans have been in actively wanting our death, some seem more ruthless than the chairman ? 
    I can't see the general football community coming together at this moment but maybe one day

    this Jimmy McLoughlin guy has rocked up out of nowhere and is now running these twitter meet ups and so on.
    the administrators were appointed in September 2021
    only 5 weeks later Jimmy McLoughlin is sat in a meeting / discussion with Mr Carl Jackson, CEO and founder of Quantuma, see link

    So what is Jimmy's agenda here? he will have you believe it is to save Derby County. 
    My guess is he is being paid by Quantuma and or Mel Morris to push the anti EFL, Boro, Wycombe motion hard to fans, and thus deflecting on the actual shambolic job the admins are doing as they line their pockets by the hour. 
    I'm now as sure as ever that Mel is still pulling the strings, still with no concern for club or fans, as he hopes to limit his losses on the MSD loan. These creditors (excluding MSD) wont get paid enough, we will not exit administration cleanly, ensuing League 1 and minus 15 points come July.

    Any money raised by selling players now is unlikely to go anywhere near creditors. It'll be used to keep the club going whilst a Preferred Bidder is selected or, ultimately, ensure the Administrators get their fees on liquidation. So creditors and opposition clubs clamouring for the club to sell players for the benefit of creditors are either misguided or disingenuous.
