One of the weird things about the £100m game or however much the Play Off final is deemed to be worth is that it's only one side of the coin. People always seem to forget the £100m in wages and transfers that will be spent in the event of promotion. Remembering the Middlesborough have greatly overspent for getting on for 30 years now, one would imaging they wouldn't be shy of chucking money at the situation. They haven't lost a penny because of DCFC, they have simply missed out on a lot or revenue and even more expense....

Exactly. I have said before that upon relegation from the PL Bournemouth had lost £94m. They recouped a fair bit through player sales like Ake etc but nevertheless the PL isn't all its cracked up to be for the majority.

This seems to be the crux of it for me too. Which, seems doubly poor when this information, unlike a lot of what he moans on about, is not only not subject to NDAs/confidentiality/etc., but is freely available.

How could we possibly submit accounts any earlier, when there was still an argument as to the form they should take?

He 100% hasn't got a valid claim. This is pure opportunism.

I suspect that the way the boardroom of the EFL works hasn’t changed much since the 1880’s, like a gentleman’s club, big cigars and leather seats.
They won’t like their feathers being ruffled and regardless of modern laws and practices will want to keep it that way.

You seem a decent chap Bobby. How do you feel about the potential for clubs to sue each other through an internal EFL process if any regulations are breached?

I think the admin teams stated view is that they are creditors of indeterminate value, but not football creditors. As such they can form part of a CVA or restructuring arrangement along with other unsecured creditors.

and have their claims reduced as a result of the statutory process . So they only get 25% or whatever they are awarded as a result of the final settlement.

I'm not clued up Pete but I didn't think that was said. They used a phrase which I thought basically meant if they followed the law of the land their claims would be squashed?

PS . I think they spoke of coming out of administration clean?

I agree buddy. The issue will hopefully go away if indeed the Administrators can enforce the law provisions as to standalone moratoriums relating to matters under arbitration (rather than Boro and Wycombe being an actual confirmed and validated creditor of any kind). Hopefully the Corporate Insolvency and Governance Act 2020 will be being scrutinised by the Minister for Sport over the coming days, and hopefully he will be giving them his Ministerial view that to ignore those provisions will leave them subject to the provisions of law enforcement too. Lot of hopefullys there.

In my unqualified view this is the only way to resolve matters. Its the only route that doesn't need any cooperation from any of the entrenched parties. Hopefully the administrators will now push hard for this.

    The EFL can:

    1. Update their own rules to reflect current insolvency legislation.

    2. Fast track arbitration

Both of those will p1ss of Boro and Wycombe because both will likely yield the same result, them being laughed out of the building.

Unfortunately, when that happens at least one of them, if not both, will turn their attention to suing the EFL. The EFL know this hence they’re sh***ing themselves. Honestly think they’d rather see us liquidated then risk being sued themselves.

Surely point one. Is not optional. They have to comply with the law.

  7. Just to reflect, isn't it amazing what wonderful fans we have. From the EFL sitting with their smug arms folded they now, due to fan power and action, have been forced into a statement of defence and have had their despicable behaviour dragged through Parliament no less. Even the parasites have come out of the woodwork.

    Well done all.

  8. So, if the administrators follow the line of David's post in the pinned thread then I guess they could literally proceed with the takeover on that basis and basically say to the EFL throw us out the league at your peril as we will sue you for everything you've got.?

The City of Derby and Ram fans have rallied, the Club captain speaks out on national radio, EFL release a statement…But where are the administrators?  They need to now come out and tell us what’s next, what we actually plan to do? It’s no good last knockings on a Friday before they log off for the weekend, they need to come out and tell us what the duck they plan to do

Hopefully they are keeping their powder dry for an almighty broadside that blows the EFL out the water!

Can we get a mod to make a thread with all of the EFL's wrongdoings over the last 2 years.  Have the thread open for people to list the points and then close it and pin it?

Bullet point format including the likes of the stadium valuation fiasco  using Morcambe's ground as a template, to telling MPs to not make public statements?

It can then be sent to MPs and the media who have just got involved and who will be unaware of how long and ridiculous this whole process has been.

This 100% Norman. Then someone much brighter than me to collate it for presentation.

    2014/15
Middlesbrough vs Bournemouth - Bournemouth failed 14/15 FFP, Middlesbrough missed out on autos

    2015/16
Ipswich and Cardiff vs Derby and Sheff Weds - DCFC and SWFC failed periods comprising of the 15/16 season, taking playoff places off Ipswich and Cardiff

    2016/17
Leeds vs Sheff Weds - SWFC failed a period comprising of the 16/17 season with Leeds missing out on the playoffs
Blackburn vs Birmingham - BCFC failed a period comprising of the 16/17 season, finishing the season just 2 points above Backburn who were relegated

    2017/18
Barnsley and Burton vs Reading and Birmingham - Reading and Birmingham failed periods comprising of the 17/18 season, finishing 3 and 5 points above the relegated sides
Preston vs Derby - DCFC failed a period comprising of the 17/18 season, taking a playoff place off Preston

    2018/19
Rotherham vs Reading - Reading failed a period comprising of the 18/19 season, finishing 7 points above relegated Rotherham
Bristol vs Derby - DCFC failed a period comprising of the 18/19 season, taking a playoff place off Bristol City

    2020/21
Sheff Weds vs Derby - If Derby's points deduction was applied to 20/21, SWFC would have stayed up due to DCFC not putting the effort in to stay up on the final day

    Have I missed any?

Add this to the time line of events I was on about and we have a very compelling case.

  12. As @Ghost of Clough said, it would be good to see a time line  of this whole saga with appropriate quotes from the the EFL during the whole process.

Remember this started with Mel trying to level the playing field by skirting around FFP issues by smart business practice. (not defending him) There were no rules in place against what we did with amortisation. They were signed off as OK for three years. After Mcguires intervention we got hauled before the EFL and found guilty of a communication breech only. We got a £100k fine. They were "disappointed" and appealed. Etc etc etc.

I have a strong sense of fair play but what has happened, including the embargoes and everything else needs laying out fully so those trying to help us understand just how corrupt the EFL are.

He gave his heartfelt plea pre match. I heard it about 2.15 ish as I was parking. Changed my view of him a tad. Negative commentator but credit where it’s due.

Anyone able to put it on here please?
