This entire drama just highlights how bitter, vindictive and inept the EFL are. Looking to change their own rules to try and stop anyone else having the right to appeal when they may have a valid case. I wonder if there is any option to take this joke organisation before CAS?

Yes, the clubs agree to the rules and vote in/agree to changes to the rules; that always has been and always will be the case. When there's no realistic alternative though it's a bit of a sham.
The EFL dictate whether you're allowed to play in their league. You could up sticks and apply to play elsewhere, but where? Shall we join ask to join the Welsh or Irish leagues? Start up our own league system?
Football clubs don't tend to have a collective conscience (albeit they often pretend to, they never do when it matters), they're in it for themselves, they're in competition with each other not in collusion; anyone who challenges the status quo is going to find themselves very much isolated with at best a handful of clubs willing to back them up.
Do we need look any further than our own doorstep for proof of what happens to clubs who challenge the rules? We've got head honcho of the EFL telling us all of the ways in which the system is broken while at the same time  slapping us down for pointing it out years ago, and for trying to work a way around it!

I have a totally different experience.

As a manager in the financial services industry and a school governor, I have chaired both disciplinary hearings and appeals. In both environments it would be unthinkable and outrageous for the person appealing to know that a failed appeal could result in an increased punishment.

That’s actually quite disgraceful that the EFL wants to stop clubs from appealing a decision that they feel is unjust - it’s a similar system used in a far left or far right country

I put some of the supporters of other clubs in the same bracket as the current climate change protestors, ill informed and unable to see anything other than their own views which (as the information is limited) is a bit blinkered. I know they will say the same about us and yes in some cases that is true.
This is what I have picked up especially from the BCFC forum.
The amortisation was very bad and the fine was not good enough. The EFL needs to take this into account when any other FFP penalties are issues. We got away with murder with the sale of the stadium and have cheated. IF and only if the stadium is sold to the new owner at a discounted rate then we should be sent back to a tribunal for possible points deductions. Not sure they can do that, isn't there a double jeopardy law for this?? If that happened (the sale back to new owners) I can understand why people wouldn't be happy with that. Also a point here the EFL did originally sign it off and asked for a small reduction which we adhered to.   We have cheated for years, overspent for years and we should have our feet put to the fire for it, made an example. Well the amortisation whilst legal for other businesses is not for the EFL. We didn't hide the amortisation (that's how it as picked up) but we could have been a lot clearer (that's why the fine was low). We haven't been trying it on with the EFL for years. They took us to a tribunal and lost, they appealed and won the amortisation part. From this we had to resubmit the accounts which we did. We didn't submit our accounts to the EFL on time, agreed that's because of the appeal and redoing them. however we could have been quicker (just my point of view), but it really wouldn't have been that much quicker.    We didn't pay transfer fees on time. Yep not the only ones to do that We didn't pay wages on time. Yep about 3 weeks late and we received a penalty for that. Others were far worse (SWFC) We didn't pay HMRC, agreed and we got a transfer embargo for that (and the others) We went into administration and appealed. Sorry are we not allowed to do that? Isn't that in the rules or doesn't that apply to us? Do we have a case, yes, will we win probably not. Also our case is different than Wigan's and I would say stronger. We should get a bigger deduction than Reading because of not paying bills (HMRC) and the amortisation. Even though they have a far bigger FFP over spend and I don't really care if they are greatly overspent next season.  We need a sustainable business plan. I agree and our operating costs have been greatly reduced with a wage bill in the bottom 3-4 in the Championship. Everyone should have aa sustainable business plan. The Gumps and BCFC have been lucky that they have sold players for really large sums, if they hadn't they would be in the FFP naughty room. Lets talk Covid. If teams are going to get debts written off for FFP(I think Stoke was +£30m) due to Covid then it has to be due to a Force Majore event, which I believe Covid is.  You cannot use it for that but not for the reason why we are in administration. If Covid was the reason (and I am saying If) then we should not get a penalty. The fact others haven't gone the same way is irrelevant. there is no law in the land that states that an owner has to cover very large losses and if he cannot for what ever reason then you go bust. Trust me I would rather we were never in this situation. Wycombe and Gibson asking for money. Fine , I still don't think its going anywhere. It it does I think QPR and Aston Villa will still be in the statute of limitations window to sue both of them for going up instead of us. I think that (play off finals) would be a stronger and bigger case (£100m each ). I do however think that this is not the way to go. people need to look at other things, Readings FFP  losses, who they have signed for peanuts (effectively a free loan), Fulham deferring payment of Wilson for 2 years. All we ask for is a level playing field based on facts and not conjecture

I thought Blackburn did a job on us today. We tried to play our game, and they were ready for it and all over us.
Second half when they knew we'd change it, they sat off and soaked up whatever we had, right up until the last flurry.
We were second best, deserved to lose, and the limitations of a squad without a fit striker were ruthlessly exposed by a horrible, gruseome side which can play a bit and has a lot of muscle up front.
    Meh. Bring on Barnsley.

What the EFL are saying and what the EFL have done to Derby over the last two years are very different things.
They are allowing two member clubs to go after us with petulant legal action despite us being in administration.
They have hammered us with punitive embargoes and restrictions for more than a full season now despite us being found guilty of nothing so far that warrants anything more than a fine
They dragged out a farcical disciplinary process that should have taken less than 12 months out for an absolute eternity at the behest of another clubs owner that had thrown a strop.
None of those things tell me that they have any interest in helping Derby be sustainable in any way. Quite the opposite, I'd suggest that a significant contributing factor to our current position is their absolute incompetence.

Yes and no. You can quite easily solve the wages issue by making it mandatory that all player contracts have relegation clauses that reflect income differences between leagues. It’s performance related pay. Nothing complex there !

The EFL gave up any pretence at impartiality when they were "disappointed" and found it "regrettable" when Derby were only fined for the accounts amortisation stuff. That is not the language of a professional body.
The mask slipped, small minded fearful men who are in thrall to Gibson, Parry and Maguire.

Derby - Hey, here's our accounts. By the way, we used an alternate method involving amortisation.
EFL - Hmmmmmm. It's unusual, but fine, we'll sign off on them.
    *Years Later*
EFL - Lol, changed our mind, now they aren't ok.

Derby - We've sold our stadium and will add the profit to our accounts.
EFL - We don't like that, but it's not against the rules. We disagree with the valuation of the stadium however.
Derby - OK. Here's a valuation from an independent company who provide a similar figure.
EFL - Nope, we don't agree with the professionals, we'll begin disciplinary action.

Independent panel - Derby didn't do anything wrong.
EFL - Meh, what do you guys know. We will appeal with a new independent panel.
New independent panel - We believe a 100k fine is appropriate for Derby's wrongdoing.
EFL - Nah, we don't like that, let's appeal. Oh and let's also try and relegate them after the season is finished.

Derby - Hey, we've renewed Jack Marriott's contract.
    EFL - OK.
    *6 months later*
EFL - Changed our mind. Marriott is free to leave. And no, you can't sign anyone to replace him, Waghorn, or any of the other players who left.
    *Months later*
Derby - Please, we don't have enough senior players to even field a team, just let us sign some.
EFL - *Sigh* Fine, but only 4 or 5. And no more than 4.5k a week! And if you re-sign players like Davies or Wisdom they will take up 1 of those spots.

Derby - Hey we're having some injury problems and would like to use a couple of young lads, but they'll then count as senior players. Can you be a little lenient with this?
    EFL - Lol no.

I'm really relieved the EFL are trying to help us and make us work. It's really nice to know they have our back.

I should, in all honesty, be receptive to alternative views. An open mind is a good thing. Partisanship is by definition, one eyed.
Yet where is the honesty and open mindedness from the EFL that has a fixed, slanted playing field via parachute payments and then whips none parachute clubs for daring to challenge. ? Their “perspective”  is worthless while the double standards persist.
They are complicit with the premier league in running a bent competition in the championship while trumpeting their own supposed moral superiority - which is baseless.
Jobsworths, pompous, self important, self promoting, illogical, biased and about as useful as the famed one legged man at a but kicking party with a big fat zero in the integrity stakes.
