Yes. His argument (he's a lawyer, apparently) is that they'd have to prove Causation i.e that Derby's actions had directly led to them being denied a place in the PL or, at the very least, the play-offs (for which the 'loss or damage' caused would be lower, since once they got to the POs it would be impossible to prove that Boro would have got further than the semi-final, particularly against teams that they hadn't beaten that season). He doesn't think they can, and most reasonable people would agree with that, but obviously we're not dealing with a reasonable person.
