    I agree with Charlotte Ram, the EFL are attempting to retrospectively apply a draconian punishment and it will be settled in court, unless they accept the decision of the independent regulator, and let us complete the takeover.

    While we’re at it, why don’t we sue Aston Villa for heavily breaching FFP rules to give them a huge advantage in the play off final, thus denying us a place in the Premier League. Using the Wycombe Chairs calculator, let’s call it 200 million.

    Most of the clubs are against us on this. 

    I don’t think we’ll get a ‘retrospective’ penalty but it’s the Tribunal not the EFl that decides that. 

    Why don’t we sue Villa ??!!  Where would we all be if club a could sue club b for breach of the rules ? Come on

    There will be no takeover as the EFL have driven the price of the club down to less than zero, Mel should hang on and tough it out if his health permits it.

     

    If you’re predicting that we will end up in court with Wycombe and the EFl, then I sincerely hope you’re wrong. It would be madness. And I would be amazed if we had any success against either  

    Mel still suffers from the delusion that if you believe you are in the right, then you will win in court. He should have learned his lesson by now 

    your point about the impact of the proceedings on the price of the club is spot on. I fear some of the chairmen have intentionally cajoled the EFl into a course of action that will hit Mel hard in the wallet

    looking at the damage that legal proceedings (EFl, Keogh) has caused us, it would seem more sensible to lawyer down 

    we’re beginning to look like the guy who’s drunk in the corner of the pub at closing time and is just determined to fight someone. 
     

    The majority of fans on here want a takeover to happen soon. That is what we need. Lawyering up is not going to help with that.

    I think you have a point. The club may want to avoid releasing compliant P&S returns before the LAP hears the appeal on sanctions. Because if the LAP knows there is no sanction except for the 100k (because the returns are compliant), then they are more likely to get stuck in with heftier penalties

    Shouldn’t read too much into it I guess but interesting to note what he has not said. He has not said he’ll go if the embargo is not lifted by _____.  Or if the t/o is not done soon.  Or if we suffer a points deduction

    Sort of agree with you about the fixtures but it’s done for Wycombe (whose owner is a US lawyer). 


    The fine is a great result but I think it comes from the panel (the DC) who initially supported us.  If the EFL do appeal the sanction, we’re back in front of the LAP who thought we deceived the EFl and thought that the EFl was unfairly criticised by the DC. So there’s an odds on chance the sanction gets worse. And we’re stuck with the decision of the LAP. 

    If as reported the new owners are talking to the EFL, then the best result for us is for them to do a deal to persuade the EFL not to appeal. But Wycombe (supported by others) will probably be able to force the EFL to appeal, and to do it quickly.  
     

    So there’s a fair chance the fine gets bigger or becomes a points deduction. But not a points deduction for 20/21 I would say, even though the dual fixture list obviously increases the chance of that happening.

    This doesn't pass the giggle test if you go back and look at the statement the club issued after losing the appeal. Talk about selective...

    Combative may not be the word. Childish petulance may be a better description. Percy's article about the 'bitter feud' is driven by the club's response to the EFL statement. It is not what we want, because it will just perpetuate the attacks on us, it will guarantee that the EFL seeks the maximum penalty  

    The on going fighting with the EFL is damaging the club, we can all see that. Why are people talking about suing them ?

    They will have told Wycombe that they will ask for this in their appeal. So they will. But it’s the decision of the panel not the EFl and they won’t get it.

    I dont think that is the question just now. That one comes later. 

    As  @JfRhas said, the interchangeable fixture list is needed because the EFl will presumably appeal the sanction decision and ask for a points deduction. That could happen within a month.  The failure to comply with P&S because of the amortisation ruling cannot lead to a points deduction last season, because we’ve not yet even been formally accused of that. 
     

    I don’t think the LAP will order a points deduction for last season for the reasons @Ghost of Cloughhas explained. But we could get a double points deduction next season, one for the amortisation charges if the EFL appeal of the sanction is upheld; and another one if the restated accounts fail the test. 
     

    We have to hope and pray that new owners swoop in and persuade the EFl not to appeal. And that our restated accounts are above the P&S bar. 
     

    if they don’t, it will be interesting to see what Rooney says and does

    Even though I don't want him at the club, the fact he is still here indicates things are progressing on the takeover front & that the news on the penalty (the severity of which I'm certain the club will be aware of) isn't as bad as first feared.

    Rooney is an unashamed careerist & there's no way he would stay if a) there were no funds to bring in players/was going to lose players and/or b) a substantial penalty incoming. Too much potential damage to his brand and ambition & he's already got a ready made narrative of 'keeping us up'. His media pals will do their duty talking up his stint & protesting we're an impossible job.

    Don’t think Rooney is in a strong position. The football community thinks that so far he’ s struggling as a manager - so where is he going to walk to ? And I don’t think punditry is likely to be his thing

    But if he does turn it around next season, he’ll be feeling good about Derby, and many of the fans who are now against him will give him a second go. So I’m not sure he’ll be out the door at the first opportunity 

    all quite dependent on the long awaited new owners of course and their relationship with him.

    Yeah you got it, it’s going to help. It’s going to help because the EFl has a massive amount of discretion in the way they manage the league. And they won’t ever exercise it in favour of clubs who keep trying to poke them in the eye.

    Turns out he feels qualified to pick the England team. Personally I think he's way off the mark with Foden comments - what does he know about effective wingers. 

    Well he doesn’t need the money the Times paid him for this (if he got anything at all). After a season that left most observers doubting his talents as a manager, there’s a fair chance he wrote this to boost his credentials as a tactician.
