    Covid has been used under force majeure in many many businesses over the past 18 months.
    How?
    My business was closed.
    My staff were at home.
    My supply chain couldn’t supply.
    Literally thousands of these cases around.
    So the administrators will simply need to prove that the covid caused the administration which in other words is demonstrating that the £20 million cash flow hit caused the inability to trade.
    I think they have a decent case.

    Wrong again, it is a common misunderstanding about the legal issue of "causation. It is the other things (eg Derby's historic overspending) that are "factors"... COVID was the cause of Derby 's administration.. unless there was something else that could have prevented us from going into admin... eg selling a player for £26 million to pay the tax bill.

    Cant speak for anyone else however…..  
    Now the Administrators have decided to appeal the -12points inflicted on DCFC, I feel quite confident that they’ve had the time to go through our accounts and decided in their Professional opinion that (due to COVID and our previous accounts and income in the seasons prior to COVID) we have a strong enough case to call “Force Majure” on our administration.
    Why else would they take this course of action if there was little/no chance of success.  
    These people are accountants after all and they won’t have taken this course of action unless they felt we had a very strong argument.

    If you ask me i think the efl and the administrators have already done a deal . Where going to get 6 points knocked off the admin penalty Buttttttttttt only if Derby accept a possible 9 points from the accounting mess up . So a total of -15 or maybe if we are ultra lucky -6 for them both . Which would tie into rooneys -12 we have a chance of getting out idea . 
    I honestly think the efl do not want to see a club the size of Derby in a lower division even if the prat Steve Gibson does . 
    Watch this space because i think all the deals have already been done on the penalty side of things , its just who is taking us over .

    Exactly, and a positive here is it's not emotive - i.e. had Mel been appealing it could be seen as "here he goes again".  It's a completely impartial group who have clearly been looking into the books, sought advice and feel we have a solid case to appeal.  If not, they wouldn't have done it.

    I don't live in Derbyshire and apart from comments about how surprised people are that we're in such a mess, fans of other clubs don't seem to care about us one way or the other. We're certainly not '' seriously disliked' universally. I bet most fans don't think about us at all.

    Administrators have said they are aiming to reduce current and future penalties. Any future penalties would be for P & s and I think it’s a fair point in mitigation that we didn’t knowingly break p & s

    I thought on mel’s stTement at the time it was obvious the reasons why it was scripted that way… not Mel just making excuses. 
     
    both Mel and the administrators have cited COVID and there are good reasons for that, not least because it’s true.

    Is that a proven method of collecting tax then?
    As a tax payer I prefer them to accept something rather than next to nothing.

    The administrators will be well ahead of us with this info. They will look to reduce the HMRC first then look to make a plan with MSD afterwards. Both need to be cooperative because if the club ceased to exist then they would receive nothing.
    There is more than a hint that something is in place, but owners need to know what is owed where before proceeding further
    As a fan it’s best to remain calm, buy a ticket some merch and hopefully some of this beer! From our point of view every little bit helps

    And yet despite everything, the EFL seem to be only too willing to increase the likelihood of liquidation by piling on the highest points deduction they can get, without seemingly taking any account of all the "reasonable doubt" that they are even right about their opinion that FRS has even been breeched at all. On top of that the Club has been punished by delay, by Covid, by embargo, by the draconian measures around squad size and wage caps.........all of this is being ignored in the pursuit of making an example of one Club, at the behest(in part) of the Chairman of another Club.
    In addition, although as we all know, other Clubs have been able to "cut a deal" with HMRC, but under new rules, DCFC will be denied this option, BUT STILL, the EFL will not budge......even though Parry himself has already recognised, that amortisation should not be taken into account in P and S calculations, BUT still they plough on.....
    Is it any wonder, that as a Club, we feel just slightly persecuted?

    I wonder if the administrators will try and strike a deal based on saying the following, at least as a starting point:
    "Give us zero or very few points for the P&S loss and in return, we won't appeal the administration under the force majeure for Covid"
    I'm sure the EFL wouldn't fancy us being the benchmark case for Covid otherwise, if they lost it, they would be in a lot of trouble.

    I don't know where you've been living, but I'm pretty sure I couldn't get in Pride Park for a competitive game between 12th March 2020 and 5th August 2021

    Got two tickets, last home match was pre COVID Feb or March 2020- was a season ticket holder for a number of years. Not been this season due to combination of other commitments, apathy about attending events after COVID and unhappiness with how the club is run but the club needs the fans now.

    That's how it currently plays out. 
    Stretton is about the only one who runs across the line and into space though some of the passes he got against Birmingham were not kind.
