    I just feel it coming … we end up with minus 16 and just before we go down the EFL announce (regretfully ?) that after much research and diligence we are due another 9 from the beginning of next season. Surely someone dispassionate like an administrator must be able to get the EFL to be up front about what they want and what they are going to do about all sanctions for past deeds. They have months to do it.

    We've got a 12 point deduction due to going into administration. We are expecting a further points deduction from the financial fair play charges. 
    The question is, when will the EFL impose this second points deduction? 
    Will it be immediately after the charges are proved
    Will the EFL wait to see where we look like finishing in the league before implementing the points deduction.
    Or will they suspend the points penalty until next season, to prolong our punishment

    It's not an argument at all. How did covid affect Derby , not how did it affect other clubs. And the fact that EFL gave a loan to other clubs but not Derby doesnt help EFL's case if that is what it is anyway.

    It’s not. Derby were in a certain situation prior to Covid. If they can prove those circumstances were manageable but Covid was an unpredictable, unforeseen (force majeur ) spanner in the works then it fails comprehensively. Force majeur by definition is something you can’t predict for yourself in your particular circumstances.  Other club’s situations are irrelevant . E.G Derby had a financial recovery / trading plan plan in place that assumed £ 10,000,000 ticket income. This was needed but it as also a conservative and reasonable assumption based on past history. Covid came along and the 10 mill became zero … That was unforseable force majeur. 
    Other clubs had different situations, they might have had more padding that allowed them to avoid our situation but that doesn’t alter the force majeur as it affected us.

    Great to hear someone taking ownership / leading the club.
    Not bothered about the prospect of league one, a dominion of vocal chairpersons, a spineless, structureless  entity that is the EFL will endevour to relegate us regardless of results on the pitch.
    Feeling much more positive following the events of today and the unity being displayed by fans has really shown that we are a prospect for potential buyers. More importantly, a step forward to securing the future of Derby County FC.

    To add to that i think it adds v v strongly to our case that the first thing the independent administation team said was 
    “this club has been badly effected by covid” 
    so thats it efl .. a professional opinion for u to ignore .. just like the accountant on that first panel that told u to stop talking drivel 
    My worry is the admin arnt there t challenge points decisions .. perhaps a new ownership would ? Or would it be too late

    I suspect you’ll find most, if not all, professional footballers have an innate desire to win every game they play in regardless of pointless it may seem. Also, from a personal perspective, I would imagine they will want to impress in order to enhance their chances of a more favourable transfer.

    In Trevor Birch's interview with Ed Dawes, just being played on RD Sportscene, Ed asked him about the fines meted out to QPR and Bournemouth and why a points deduction wasn't applied when they came back down. 
    Birch said that the rules were applied in accordance with what they were at the time. This is factually incorrect. The rules said :
    In the cases of both clubs, the EFL agreed a reduced fine that equated to approximately half of their excess losses. In QPR's case, this was halved again because the EFL allowed the owners to write-off loans of around £20M. This was done for expediency because QPR had fought the proposed fine through arbitration and Bournemouth (being in the PL) resisted settling their fine until the QPR case was settled.
    The final irony is that the current version of the FFP rules were ratified at an EFL conference at PP in November 2014. I bet MM wishes he'd pissed on the sandwiches.

    Not true. It says that the force majeure event must have caused administration directly and the owners must have used all reasonable efforts to stop admin from happening.
     
    whatever mess we were in before COVID happened is irrelevant , it’s what happened after then did the owners do enough to stop admin happening ?

    I really hope you are right. We have breached .. in the first instance we deserve sanction and with the Admin, we deserve relegation.
    We don’t deserve to be repeatedly kicked when on the floor.

    Yes, the key thing is to have it all deducted this season and we can start afresh in league one. If we start next year with more points deducted it could be a death spiral.

    The EFL are dealing with professionals now and not Morris. They will give us due punishment and we will have it legally tied up. Personally I don’t care if it’s 4 or 44 as I think we will be in league one regardless. For the first time in months I feel the bottom of this mess may be in sight. At least when we finally get there. The only way is up COYR

    If it's an agreed outcome we may not get the full details publiclly available, but you'd think there'd a be a joint wording agreed. Perhaps something like:
    "The recalculated P&S information produced by DCFC as instructed by DC2 showed a breach of P&S spending limits. Given the unusual nature of the investigation and breaches relating to previous seasons and corrective actions were not taken at the time they ordinarily would have been taken, it has been agreed with the club (in line with EFL rule 85) that a penalty of -9 points will be applied this season, with a further 3 points suspended, pending future conduct. A business plan has also been agreed with the club to amend it's current and expected position with regards to P&S. The agreement represents what both parties have agreed is a final conclusion to the issue. We thank the administrators of DCFC for coming to agreement with the EFL to resolve the issue and wish them every chance in securing new ownership and a long term future for Derby County."

    I genuinely believe we will get new owners, that many of the woes of daft salaries and unsustainable finances will, to a certain extent be reset. I also know we will go down, but I’ll be shouting for the team at every home game. We can ride that, they still play football worth watching in league 1 and we can come back. 
    My huge huge fear is a second major deduction … so we end up in league one, on minus points with quality players leaving, the guts ripped out of us and the smell of death hanging over us. why would they stay, why would anyone want to join ? The after shocks would just go on.
