Jim Wheeler said last night on radio Derby that from his source the Appleby group were happy to contend the Boro and Wycombe claim.
Today Nixon saying this is holding up that group. I hope the MP's meeting might flush out the truth so we know.
 

It sounds like Nixon has a mole at the EFl feeding him info.
Solve Boro and Wycombe issue, the preferred bidder can deal with them later.
It sounds like the government needs to step in and quickly as the EFL will not budge.

There are enough disgruntled fans out there from numerous other clubs to raise the notion the EFL isn't fit for purpose, us, Birmingham, Bolton, Wigan, Bury, Macclesfield. 
If a coordinated effort was made to bring fans together and get everyone banging the same drum the cause would soon gain momentum. Look at what we achieved in a few days last week.

Here's hoping that the soap opera that is Derby will be the watershed to topple the EFL

If the administrators name a preferred bidder who is willing to take on the claims can we come out of admin as long as the EFL are happy with the fit and proper test before those claims are contested ?

To my knowledge this is the first time isn’t it that two member clubs have sought compensation for FFP/P&S abuses from another member club? If the claims do proceed to compensation being awarded, and/or ultimately bringing our Club to a close, then a very big precedent has been established. This seems like a watershed moment. You would think that there should be an extraordinary general meeting called in which all 72 member clubs are briefed as to the position, and a vote should be taken as to whether the membership are supportive of such actions being taken. They all should be aware that they might be next in the money merry-go-round, and that once the compensation box is open that each season thereafter multiple claims are likely to arise. I think that would focus a few minds if it was put to an extraordinary membership vote.

It would help if other clubs could write to the EFL in support of us as the efl say they want to keep the 72 happy.

Three parties have made offers, any one of which would allow the club to exit administration with a substantial payment to creditors.
These offers need clarity, that the claim by Boro and the potential claim by Wycombe do not qualify as Football Creditors.
The football creditor rule is not defined in the EFL regulations, it is part of the Articles of Association of the Football League Limited, of which all clubs are minority shareholders (the golden share).
The football creditor rule is in Article 48, which clearly defines what constitutes a football creditor, copied below from Companies House.
The rule clearly states that it is to cover payments of "debts due". How possibly, can an unproven, unquantified claim such as Boro's be consider a debt due?
If the EFL is suggesting that any claim by a football club or employee, which is unproven, should be classified as a football creditor it would create mayhem. And, bona fide football creditors with debts due, and other preferential and unsecured creditors would lose out as a result.
The EFL can't have this both ways. If they choose to say Article 48 does not qualify Boro's claim as a football creditor the EFL are suggesting they might be sued by Boro.
However, if they choose to say that Article 48 should be interpreted (which is a wild stretch) in a way that Boro should be classed as a football creditor then it is almost certain that the EFL would be sued by the Administrators and the creditors including genuine football creditors, and HMRC for their easily quantified losses. 
The EFL also risk being sued under section 994 of the companies act for acting prejudicially against the interests of a minority shareholder of the football league ie. DCFC.
We need to apply pressure on the EFL to get off the fence, see that their actions alone are preventing the Administrators from getting a deal agreed. 
Article 48 says that Boro's claim cannot be a football creditor and the EFL must state that and stop this nonesense.
"48         FOOTBALL CREDITORS
48.1      Where a Member Club defaults in making any payment due to any of the following persons, 
the Member  Club ('Defaulting  Club')  shall be subject to such penalty  as the Board may decide 
and subject also to Article 48.2:
48.1.1        The League, The FA Premier League and the Football Association;
48.1.2        any of the Pension Schemes;
48.1.3        any Member Club and any Club of The FA Premier League;
48.1.4        any holding company  of The League and any subsidiary  company  of that holding 
company;
48.1.5        any sums due to any full-time employee or former full-time employee of the Member 
Club by  way  of arrears  of remuneration  up to the date on which that contract  of employment is 
terminated. This excludes for these purposes all and any claims for redundancy,   unfair   or  
wrongful   dismissal   or  other   claims   arising   out   of  the termination  of  the  contract  
or  in  respect  of  any  period  after  the  actual  date  of termination;
48.1.6        any  sums  due  to  the  Professional  Footballers  Association  in  repayment  of  
an interest  free loan together with such reasonable  administration and legal costs as have been 
approved by the Board;
48.1.7        The Football Foundation;
48.1.8        The Football Conference Limited trading as "the National League";
48.1.9        The Northern Premier League Limited;
48.1.1O      The Isthmian League Limited;
48.1.11      The Southern League Limited;
48.1.12      Any member club of the League or organisations listed in Articles 48.1.8 to 48.1.11 
inclusive;
48.1.13      Any County Football Association affiliated to The Football Association; and
48.1.14      Any Leagues  affiliated to The Football Association  and any clubs affiliated to any 
County Football Association recognised by The Football Association.
48.2      Subject to the provisions of Articles 48.3 and 48.4, the Board shall apply any sums 
standing to the  credit  of  the  Pool  Account  which  would  otherwise  be  payable  to  a  
Defaulting  Club,  in discharging  the  creditors  in Article  48.1.  As  between  the Football  
Creditors,  the  priority  for payment shall be in accordance with the order in which those 
Football Creditors are listed in Article 48.1.
48.3      If,  having  discharged  all Football  Creditors  in  any  preceding  class  of  Football 
 Creditor  (as
· required by Article 48.2) the sum then available is not suffident to discharge in full the 
Football Creditors listed in Articles 48.1.1, 48.1.2 or 48.1.4 the Board will decide the 
allocation.
48.4      If,  having  discharged  all Football  Creditors  in  any  preceding  class  of  Football 
 Creditor  (as required by Article 48.2) the sum then available is not sufficient to discharge in 
full the Football Creditors listed in Article 48.1.3, 48.1.5, 48.1.12, 48.1.13 or 48.1.14 the sum 
will be allocated pro rata amongst the creditors of the same class.
Note - Clubs are reminded that any assignment of future entitlements from the pool account are 
subject to Article 45 and this must be brought to the attention of the other party. Furthermore 
assignments must be in legal form and registered with the office. Assignments are given priority 
according to the date and time of registration."

As you will see and no doubt be aware it clearly states that sn agreement was reached between the EFL and MFC in relation to future claims against DCFC. 
 
I would greatly appreciate your view on this in relation to the current situation.

It’s good news. The whole point is not for the MPs to get the EFL to settle today - they won’t - but to be part of the pressure ratcheting up on the EFL to get to the point of agreement.
So far the EFL have interfered in all the wrong places and not interfered when they should have done. They can’t ignore the MPs and won’t, especially when they know that an independent regulator, which they don’t want, is on the Government’s agenda. So MPs pressure on them is both uncomfortable for them and important for us.  They need to be encouraged to find solutions and that’s what the meeting will help to do.

Never knew my Grandad he passed away in 1933 when My Dad was 5 years old, Alice my Grandma never remarried but apparently had a few boyfriends ?.
So I guess it was all down to my Dad, He was born in Joseph Street a 5-6 minute walk to the BBG, A quiet fella he was, Never really spoke about his family or his past...he was ex forces, But would talk about DCFC not a great deal but enough for me to know who they were.
So as a 10 year old instead of going to the local pictures in Chadd the Essoldo I decided to go down town(Derby)and watch the market traders on Cockpit Hill, With 1s-3d(7p)in my pocket I set off from home(Trenton Green area)across Chadd Park, Along Nottingham Road, Through to the old cattle market and to Cockpit Hill, Stalls all set up on the cobbled stones, Me just mooching about watching and listening, Now as a 10 year old they were the times you were chucked out of the house and told not to come back until tea time, Life was pretty safe in those times.
Anyway, I saw lots of folk walking from the bus station heading towards Siddals Road where the old paint factory was(pavement was yellow and red through spilled paint)so I decided to follow them...I was an inquisitive kid(nosey)so followed not knowing where I was going or where I was, Approaching Ivy square, Dairyhouse Road, Cambridge Street then the BBG, Yes it clicked this was what my Dad called Derbys home ground, I never had the money to go in so played/talked with the local kids, They were waiting until around 4-30pm when the gates would open and they could get in the Kids Pen, So I waited and yep we all got in, The last 10mins, We played PNE...won I think 1-0 or 2-0 I could just see over the painted wall at eye level, I remember the noise and the smell of cigarette smoke.
As a 10 year old in 1966 pre World Cup Winners, It was playing Hide n Seek, Cherry knocking, Cat Creeping, Hop Scotch, Riding your Bike or Marbles in the Gutter, This football was something new to me, Something I wanted more of, Money was tight in our family with both parents and 6 kids, All were fed and clothed and given pocket money of 1s and 3d, That was enough to get me into the pictures 6d to get in and 9d to spend on sweats.
So it was a case of a paper round or saving up, There were no paper rounds as all the bigger lads had got them, So I had to save up for the next season, I still went to the pictures but sneaked in so I saved the 6d and only spent 6d on sweats, So 9d a week could be saved, I walked to the ground from home around 70mins as I didn't want to spend money on bus fare, Season 1966-67 was my 1st season, I went to around 10 games...My 1st game was the 1st of the season Blackburn Rovers we lost, But the excitement being in a crowd of 1000s was something I couldn't forget, A pocket money raise the next year so a few more games were taken in, 1968-69 was my 1st full season and what a season it was...arise one Brian Clough and his assistant Peter Taylor.
Division 2 Champions, 4th in our 1st year, 2 League Championships, Europe, FA Cup, Quiz Ball Champions(TV)the worst pitch in English football...well the rest is history, I've fought, Been clumped by away fans and the Police, I've made a shedload of friends, Travelled North, South, East and West, All weathers, Begged, Borrowed and Stole to get to matches, Have a Ram Tattoo now covered over, Ate, Slept and Drank DCFC, Bought the T shirt, DCFC was my life, If we lost I go into a sulk for a couple of days, Then the weekend was soon upon us and the buzz would start.
There will only be ever...ever one club...Derby County FC.

anybody who follows my twitter link @phillowe1 may well have seen some of the fantastic posts that i have put up from it, it is a documentary from 1984 the centenary season, we were in Division three, we had been taken to the courts, we hadnt paid our dues, we were skint and facing death, its the history of the club from 1884 to 1984 and you will be amazed !!!
