    Continuing on this theme, how can it be fair to dock points after the season has finished? A 2 point penalty given before the last game would have meant us still going for a win in those last 10 minutes rather than sitting on the draw. Wednesday had all season to make up their 6 point penalty.
    I think that Derby would appeal any decision resulting in a points penalty for last season and knowing the speed of the appeals process, this wouldn't be decided upon until after christmas.

    A law suit may well be in the offing. But by bandying around phrases like 'systematic cheating' it might be heading his way, not to Derby!

    ….and I don’t think I’ve ever been less excited about them!
    Fixture release day was always the watershed between seasons in my eyes; time to look forward to the circus rolling into town once again. 
    But this year feels like the clowns are already here.

    No one seems to have asked if we can actually afford to pay the £100k fine. After all, that is more than our envisaged player recruitment budget for next season...

    The accounts submission is tomorrow's problem; today's is whether the EFL accept the punishment handed down for the accounting policy breach.
    From the Club Statement, there seems to be open acknowledgement that the EFL wanted a points deduction for it - but, if they do appeal the sanction, to go from a £100k fine to a relegation-inducing retrospective points deduction would take quite a change of attitude from the Panel towards the 'value' of the breach.

    I think we might be giving too much weight to the 'interchangeable fixtures' statement. Given the timing of the announcement of the punishment and the release of fixtures so close to it, the EFL are just covering the bases.
    There is an appeal period built in to the decision and, to take advantage of that they either had to plan for a relegation contingency or hold back the entire fixture release for both the Championship and League One.
    Just because they have -sensibly - covered the bases does not mean they intend to appeal.

    There's still a good possibility that the EFL don't appeal.
    They got the judgment yesterday. Presumably they argued for a points deduction, and that is why they had already developed the option of interchangeable fixture lists.
    They have the option of an appeal and right now they are thinking of it. If you don't get what you want from a judgment, your first public statement is that you are considering the judgment and considering an appeal. No point in committing yourself either way.
    But it doesn't mean that they will appeal, because that will depend on deciding there is a good chance of showing that the DC was too lenient, or got something wrong. When you're talking about punishments, the DC will have a reasonably wide range of possible responses within which the Appeal Panel could not say they were wrong. It may well be that their advice will be that the DC could not really be said to have got it wrong, even if they disagree with it. 
    The appeal provisions say: "the Appeal ... shall be limited to a consideration of whether the decision being appealed was in error and the burden of establishing the decision was in error shall rest with the appellant; and ... in the case of appeal against sanction, the grounds are that the original sanction was too severe or too lenient having regard to all the circumstances."
    So I actually doubt that in the end the EFL will appeal.
    Wishful thinking maybe!

    A friend of mine who works with Umbro - the one who told me about the pink last year - has mentioned that the home kit has blue in it this year. He was very cagey, so no further details other that, but could it be back to blue shorts?
    He also said that one of the two away kits was 'stunning'; the other one was a bit boring.
    On behalf of B4 I asked if there was any pink involved and he said 'not in the outfield kits' - maybe a pink keeper's kit?
