    I didn't think they could given DCFC are in admin? Goes against insolvency law unless a court deems it permissable?

    I don't think the HMRC are aware of the qualities of Jason Knight.
    HMRC (the Government) have said its not a problem. However you try to spin it, its The EFL trying to squeeze Gibson in as a football creditor that is stopping DCFC being allowed to survive.

    I really don't know where you're coming from Kevin. The government clearly said in the House of Commons that the HMRC debt is not the issue here.
    The sports minister said it at the end of the debate last week.
    The only thing stopping this club surviving is the vexatious ambulance chasing Gibson and his chum Parry.

    You do sense that whilst that maybe their position, they are being very careful not to publicly choose a side even with yesterdays statement. 
    Could EFL regs trump insolvency laws? I'm not so sure.
    However, any resolution achieved cannot ignore or sidestep EFL Regulations or UK law and any solution needs to be found that satisfies the competition regulations and the terms of the EFL’s Insolvency Policy that was set and agreed by all 72 members, including Derby County.

    I'm not sure what is so confusing about this, the administrators have told RamsTrust that they have consulted with 3 QC's who have said that it would unlikely to ever succeed in a court of law.
    And RamsTrust go on to say:
    They also stand by the view that the claims should not stand as Football Creditors and are working with the EFL to confirm/clarify this.
    "They" clearly being the administrators, as the QC's would not be in discussions with the EFL.
    Kevin has read "deep" into this and came up with the administrators must have asked 2 questions, with one of the answers excluded, which would suggest the administrators are ignoring their QC's by pushing ahead with trying to get the EFL to clarify...oh and according to Kevin, Quantuma wrote the whole thing.
    So no, we do not agree and I'm finding it hard to believe how this is all being twisted this morning. I'm off to put the kettle on and find the paracetamol.

    "They" is the administrators in this instance. If you read it fully it's easy to understand that's it's written by RamsTrust, not Quantuma as has been suggested.

    Kevin, whilst I broadly agree with your argument re football creditor status and also think it's pretty clear (based on the first post in this thread and the precedent of Middlesborough Vs Liverpool) that Middlesborough and Wycombe would be football creditors if they won their cases, I'm not clear why you're so certain regarding your interpretation of RamsTrust's minutes of Quantuma's statement.  The paragraph you have quoted in support of your assertion is this one.
    "The administrators have received 3 QC opinions to the effect that the claims are unlikely to ever succeed in a court of law. They also stand by the view that the claims should not stand as Football Creditors and are working with the EFL to confirm/clarify this."
    This has been written by RamsTrust not Quantuma so it's not necessarily carefully constructed legalistic language. It is certainly open to the interpretation you have given it but reading it purely literally, it's not even explicitly stated that Quantuma have  actually asked the QCs for an opinion on the football creditor status issue. 
    This reads to me like two related but independent sentences about the same underlying issue. I wouldn't make the implicit assumption you have that the QCs were asked their opinion on both issues but only concurred with the administrators on the first of the two. There's just not enough evidence for that, especially given that this report has been put together by supporters groups rather than lawyers.
    I'm not saying you're wrong, I'm just confused as to why you're so certain you're right and wonder whether you might be over interpreting this particular paragraph?

    I am off to sleep buddy, but I think you are reading far too much into BAWT minutes. You stress ‘written very carefully’ and ‘carefully crafted’ sentences, but what evidence do you have, other than reading between the lines, that the QCs were unable to support Q’s position that the claims should not stand as football creditors ?

    I have read it and understood it, but at no point does it ever suggest they would be unable to support Quantuma's position. I'm truly baffled as to how you have taken that from the paragraph.

    I have CFS so know what you mean Paul. I think partly it's psychosomatic for sure in the case of ME/CFS but it is a real medical issue that is unrecognised. If I do some exercise or gardening then the day after I can barely move. Most days I wake up in the morning having had plenty of sleep but tumble out of bed feeling like I've just run a marathon. My legs hurt all the time, my head is groggy, I get viruses and things at least every 3 months which in turn impacts on your health and state of mind as it would.
    Some days you are pretty ok and others you can hardly function and it's also the unpredictability of this that means planning for things is an impossibility. I've been on holiday before and spent large parts laid up. I have to cancel things or rearrange last minute depends on how i'm feeling and work since it got bad the last 5 years working has been tough as I have to work from home because I was off ill frequently in other employment.
    Going to football also is a long day. Some people can just rock out of bed, get ready and head off out on the train with mates for a few beers and a bite to eat then head off down the iPro and have a great day out. I have to push through severe fatigue, plan the day which in turn causes stress and anxiety which exhausts your adrenal system and makes you even more tired, then there is the drive to Derby and the hassle of finding somewhere to park, then the sheer number of people you face milling about at the ground which can send your senses a bit awry. To be honest the easiest part is just to be sat down in my seat and then I can relax a bit for 90 minutes.
    The way we think about things, whether we worry or have anxiety about things gradually takes it's toll on your health and it's incredible just how the manner in which you react to set backs and situations over many years can have such a profound detrimental impact on your way of life.
    I feel for Paul as I haven't got the medical issues that he has and mine probably pale into insignificance when compared but in terms of chronic fatigue and one day looking ok to people, I completely agree. It's a challenge every single day.

    I'm sorry, but Martin Kuhl cannot be on that list.  To be a defensive midfielder, you had to be effective defensively.
    Kuhl may have been the final piece of the jigsaw, however it was certainly not the jigsaw we had at the time!
