    Derby just don't seem to have a player wanting to take a shot. Awful lot of tippy-tappy around the box. Would like to see some of the lads just put a boot through a few and see what happens.?‍♂️

    PB will likely not be announced today. This is absolutely no reason for people to wet the bed. Bids went in on Wednesday so there is more than one party trying to buy the club. Some people need to just calm down. It will take as long as it takes and the admins know exactly how much time they have to reach the most optimal solution for the creditors.

    It's time for Derby to commence legal action against the EFL, the other clubs that have remained silent throughout this process will be hit in the pocket.
    Why? Because it's the right thing to do to protect the game we all love. We cannot allow the EFL to continue as they are. Sooner we have an independent regulator the better.
    They have broken the agreement that prevents clubs from taking action against each other, reg 4.4
    They have failed to take action against both Middlesbrough and Wycombe under reg 3.5 which prevents clubs from unfairly criticising, disparaging, belittling or discrediting any other Club.
    They are ignoring the Arbitration Act 1996 with regards to insolvency and the football creditor status, attempting to push this through arbitration regulations, ignoring 4.4.
    Surely we have more grounds than any of the clubs that have threatened legal action.
    With the above we have been forced to sell assets for a low fee as we were prevented by offering contracts. We have incurred additional administration costs, which will increase the purchase price of the club, potentially forcing us into liquidation if the cost continues to rise.
    With that it's 3am and the dog is looking at me, I can feel the questioning why are we not going to bed with his eyes.
    Feel free to rip apart any of tonight's rants, I'm not a legal expert, far from it, but I am capable of reading and processing words.

    That tells you a lot though doesn’t it,  that we don’t know the details of his claim?
    The truth here is not difficult to discern. Gibson and Morris detest each other. The reasons are lost in the mists of time and who cares? 
     
    But we, Derby, are now in the position where - but for these claims - our club would have been sold in January. 
     
    You say that Gibson has no desire to see Derby fold. You’re missing the point. The point is, his vendetta against Morris has pushed our sale back, he has trashed Rooney’s transfer window and he has put us at serious risk of liquidation. Our club is collateral damage in his nasty, squalid scrap and that is not acceptable to us. And I believe Gibbo also calculates that if he damages us, MM will be forced to pay for the repair, and he likes that. We see what has gone on and it is not acceptable to us.   
     
    All is revealed in Gibson’s open letters - cleverly drafted by his PR and legal team. They are disingenuous, misleading and largely irrelevant to whatever the claim might be. And with each letter, the goalposts move, now it’s FFp, now it’s the stadium. (Don’t worry, we know Morris’ letter is not much better.) There is nothing confidential in his claim, so why has it not been articulated in the public arena? We know the answer. 
     
    Even Couhig (whose behaviour is possibly even more revolting than Gibson’s) has had the sense to realise that to threaten a claim in these circumstances and without fully articulating it is beyond the pale. 
     
    The outcome here will most likely be that MM will put in place arrangements to indemnify the club, that those arrangements will remain in place for several years at significant cost to Morris and that the claims will never be brought. (Mission accomplished for Gibbo, the worst kind of playground bully.)  And that Couhig will slither away to begin another attempt to exploit some legal system or other. 
     
    Our owner has done a few shameful things in recent years. Nothing on the scale of what yours is currently up to

    Just been looking across forums and social media, gauge the reaction from the Boro side to the statement made tonight.
    If they believed Gibson had a strong case, surely the reaction would be to say bring it on, but that's not the case at all.
    The majority are not interested, he can't do that, doesn't mean it, even no to arbitration, just pay up with the £40m figure being banded around.
    Did come across a few that would prefer to see this dropped completely, but as I say the majority appear to be more interested in extortion with the backing from Forest and Leeds fans.
    I would hope that Gibson has bigger balls than his own fans, and the desire to see his claims of systematic cheating proven in a court of law.
    What does he have to lose?
    Continue his claims through arbitration where his counsel is not free until May, which by that point we could be liquidated and wouldn't see a penny anyway.
    There is no bidder willing to pay extortion money, so this is the best offer he has of seeing a penny of what he thinks he's owed.
    Anyhow, 1am that's enough. Weekend off now with Twitter notifications on for the EFL Comms account to see what the EFL's true intentions are for this club.

    Gibson says all he is interested in is the money from the compensation, Derby have no money. Mel has money, and its same case against Mel as it would be against Derby. If Gibson is confident of his case and all he wants is the compensation then the High Court route looks ideal for him.
    However,  if Gibson isn’t confident of his case it could prove very expensive for him.
    it’s a “put up or shut up” moment for Gibson

    Rooney was careful with his wording yesterday. I took from it we would have the same squad to the end of the season and we have. Anyone saying he’s been lied to by admin and he’s lying to us needs to give their heads a wobble. Yes it’s bloody frustrating and soul destroying but we’ve got money to keep the club afloat while the takeover is hopefully sorted and we’ve still got Bielik Lawrence Bird Knight Buchanan and Festy. The great escape is very much on.

    Heavy sigh. Has this account been compromised? It seems to currently only comment with half-truths pretending to be 100%true. 
     
    I don’t want to get into a pissing match. But, mate, everyone of your statements are made with some level of knowing, yet it’s using incorrect information. The biggest grievance I have with your comments: 
    You keep stating the EFL are simply asking for the claims to be paid in full. Well, they can’t demand that. Boro are NOT creditor’s, and therefore do not fall under that statute I’ve seen you post. 
     
    Furthermore, it is outside of the EFLs purview to appoint creditors without legal cause. This point is crucial, as Boro and wycombe have zero legal cause to claim monies from Derby.
     
    It’s as if you were sat at the closing table ready to sign for the new keys to your house, and some bloke comes in the room and says, wait, you owe me 100 thousand pounds. The room all ask the guy if he has any proof…he says well no, but give me the money. That interaction  is exactly what Boro are doing here. And that type of interaction is not going to stop you from closing on your house. 
     
    Therefore, EFL are outside of their remit. Which is what the Administrators pointed out in their last statement. 
     
    I really hope you are just performing some expert level trolling here. But please dial it back a bit for the mental health of some of our supporters here:)

    It would seem you care, as you're bringing it up again now.
    Having been on the Supporters Charter Group myself, I'm fully aware of the process of official minutes as oppose to minutes written by each individual supporters group. As you was told, on the rare occasion Quantuma wrote the minutes. 
    So yes, I was wrong on that particular point, however it does not change the fact what you are trying to claim is not there. If you are so sure of this, write to Quantuma and have this verified.

    I have read the minutes, at no point did it say the QC's refused to say they are not football creditors. Caps lock posts do not change this, it's simply not there no matter how many times you repeat this.
    You also do realise that this arbitration is to settle the argument, are they football creditors or not, don't you?
    The EFL are under pressure from the two clubs to make them full creditors and also from HMRC to sort it out as they have accepted a massive hit on their demands.

    To say the football creditor status is neither here or there is completely missing the whole point of the arbitration. It's literally the main point thats being contested.

    To those of you in despair or anger over today's announcement, stop.  However hard that may be try and stop. Think positive thoughts, deep breathe, talk, write on here, open the wine or whisky, kiss the spouse and children or dog, whatever it takes.  It was always going to be something along the lines we have heard and it is not (yet) bad news.  It could even be good news.
    Every single negotiation I have been involved in - and there has been a fair few over my career much larger than that of our football club, though none as complex - has had one feature.  They’ve all gone down to the wire.  Every single one.  It’s human nature - all sides think they can squeeze a little extra.  Think Brexit (or every single negotiation with the EU ever).  We knew what was going to have to happen months and months and months out (and it’s still not finished) yet there they all were at one minute to midnight (and beyond) negotiating away, deadlines being pushed back and changed, deals being done, compromises reached. Think Northern Ireland or South Africa, Unicef or the United Nations. They’re all the same.
    Our deal is about as complex as those given all the parties involved and all their different interests. There is no single ‘truth’ just as many truths as there are parties in the game. Cans will continue to be kicked down the road until the end game is reached and perhaps, just maybe, we are closer to the end game than we were this morning.  This is good news because it concentrates minds.  It’s also harder on us, who have considerable skin in the game but no direct involvement in the negotiations.
    The reason we might now be in the end game come February 28th, is because that is when the Administrators say they run out of money.  At that point I suspect they have to liquidate us.  They can’t raise enough money by selling players in the next 4 days (which is good news) to run to the end of the season; they might be able to borrow funds but I suspect that option is reducing so I guess they are running out of options other than to agree a PB and get some funding that way.
    The PBs will know that too and, if they stay interested, and why wouldn’t they having got this far, their opportunity to squeeze the deal is coming.
    The incompetent EFL and their assorted hangers on are also having their minds concentrated.  I genuinely don’t believe the EFL want us out of business - there’s too much trouble for them in renegotiating the Championship table - not only prize money but also promotion and relegation.  We’ve taken good points off top teams; lost to lower teams - they’ll all have a claim in the outcome.  And by the end of February there will still be 30 points or so to play for, enough to change positions in the final table enough for our results to still influence.
    So too Mel.  I don’t believe that he wants us to go out of business but he has a part to play and that will feed into his ego as well as his bank balance.  I have no idea how much he is currently worth, almost certainly a lot more than I am, but he has clearly signalled for a long time that his years of largesse were at an end so I would guess that he has much less than we all think he does and what he used to have. His is emotional attachment as well as financial.  So I don’t blame him one bit for continuing to have a role to play, if that is what he is doing (and none of us know).  And, unlike most I accept, I trust him still to do right by Derby County, despite the opprobium that goes his way.  We shall see.
    But even when (if) a PB is announced, that is by no means the end of the game.  Negotiations will continue, possibly for months to come.  There will be good days and not so good. Cans will continue to be kicked but, hopefully, the immediate threat of liquidation will be temporarily lifted.  We will no longer have to think of Luton away as being our last match or Millwall as our last home match at Pride Park
    We have a role - a really, really important one.  We have over the last 10 days successfully raised our case in all kinds of places that hadn’t thought of hearing or talking about us - Parliament, MPs, Council, BBC Breakfast, Talksport, Radio 5 Live, Radio 4 Today programme, national newspapers and all the rest.  Our job is to continue.  We HAVE to keep this going. They will all want to move on to the next big thing. Our job is to keep Derby County peacefully but consistently in the news. Keep the pressure on.   We need more from our local Radio station, our local celebrities and MPs; we need more from our councillors. We need to make the EFL and others understand the strength of feeling, feel the pressure again and again and again.  And we are the ones that can provide the pressure.

    The problem seems to be that Quantuma are basically stuck in the middle. It sounds like they've managed to negotiate something with Morris for the stadium and with HMRC, but the bidders have all rocked up and decided they won't pay one or both of them.  Similar sort of issue with 'Boro/Wycombe.  They're trying to do a massive multi-party deal with dozens of people involved, and there's just no consensus there at the moment.  You get 3 to agree, then the 4th blows the whole thing up.  I'm honestly not sure what Quantuma could actually do better - if HMRC won't accept less than 25%, and Ashley won't pay more than 15% (made up figures for illustrative purposes), then no amount of begging from Quantuma will bridge that gap.

The Admins can’t really make a move or statement with out an official (in hand offer), Binnies move made others officially bid for club, as opposed to negotiation. 
     
    2. If number one is true, then Derby shouldn’t see any more player sales (at least not forced sales). 
     
    3. if One and Two are true; Derby will likely see a takeover in February. Unfortunate to have passed the transfer window. But, knowing that a takeover is officially underway now…the focus can turn back to the daunting task of staying up. Knowing the club is going to continue on and players/coaches not having to worry about jumping ship before the club folds. 
     
    as always, this is my speculation on this seemingly small(yet potentially massive) development.

    Just read through Nixons tweets today, from what I can see, he has said - 
    - EFL have met 2 bidders  1 being CK who is now out & Appleby
    - Appleby in the frame still if money is there
    - EFL wont have met the Binnie's unless that has happened in the last 24hrs
    - No mention Ashley is out, but wont be Ashley who is named PB as it stands
    - Sounds like no progress from todays meeting
    - Possible 1 month extention for proof of funds, which he also says makes sense for a PB to pass EFL owners test
    - Possible extra funds from MSD to cover this 1 month extention
    - Bournemouth interested in Lawrence
    - 2 players Rooney wanted a few weeks back were Fielding & Diallo

    In theory if the bid is accepted, then yes. Ovbiously as there's still a way between prefered bidder and deal done and we're out of admin when the deal is done and creditors paid.

    If I recall. Wasn’t one of the possibilities for a prospective buyer to accept there are active claims against the club, and deal with them later? Very risky for any buyer.
     
    Wasn't some form of that in one of the EFLs latest statements? 
     
    If so, this offer sounds like it’s taking that path.

    So what do the admins do now? Two things 
    1 Dear Binnie family   You have made our day, our week actually - we’ve had a tough time recently. We loved your offer. Our duty to creditors - you will understand - requires us to ensure we get the best possible terms. We will accept your offer if we don’t get a much better one by close on Monday, yours etc
    2 dear Big Mike, Andy a et al. It’s time to $hit or get off the pot. You have 72 hours to beat the Binnie offer by at least £5 mill with a contractually binding sealed bid commitment which must contain your agreement to expose Gibbo for the maggot that he is. Oh and Couhig too  Yours etc
