Love the childish idea from Boro that Gibson is a flawless character standing up to Derby for Boro and the good of football generally.

Can I ask when the bastion of football fairness will be taking action against Bournemouth for hammering FFP on their way up, taking 4 points off you.  Take them off Bournemouth and give them to you and your automatically promoted, no playoff lottery or anything.  I'll wait with interest.

I can't disagree with this statement as I can't prove otherwise, by the same token I'm not sure this is something you can prove either.
Having visited the Sheffield Wednesday forum there isn't a lot of love on there for Steve Gibson, I would image Liverpool fans would also not agree having been on the end of his legal action along with other clubs. There is also a small matter of the Man United fanbase that have been questioning the claims in their support for Wayne Rooney.
You can only base your views on what you see and hear, and right now Forest, Leeds and bizarrely Bristol City fans have been very vocal in their support of Steve Gibson, although this will be down to rivalry....except for Bristol City which is once again just bizarre.
I don't know the guy, won't claim to know his life story and the shenanigans he may have been in, but what he has done against this club is unforgivable.
Make no mistake, he is not responsible for the position we are in, he has been responsible for prolonging the situation with his frivolous claims which let's be honest, the club were never the intended target in all this, it was Mel Morris.
Let's also not forget, nowhere would you find Boro fans complaining at the time in 18/19, Tony Pulis was the target of your frustrations and rightly so, only now that Gibson's claims became public are Boro fans out in force to support their owner, which is commendable.
We have seen the benefits of a siege mentality ourselves recently, even clubs such as Leeds which we dislike with a passion, you have to applaud the way they defend their club and anyone connected.
End of the day, it's quite possible the club could have been sold long before we entered administration had we not had these claims over us, they have been the main stumbling block. That's 12 points back on the board, no Embargos and we could potentially be challenging the top 6 with you this season.
I know Boro fans will argue justice has been served, especially if we go down, but relegation is not a punishment the EFL can just hand out.
If you want to hear tales of how great Steve is, what a gentleman and upstanding person in the community, you will not find that on here, so don't be shocked to read plenty of vitriol aimed towards Gibson and in our eyes it's fully deserved. Every single bit of it.

Overall, yes, he is well regarded (still) and in terms of protecting Middlesbrough's interests he's gone above and beyond to atone for giving Tony pulis parachute payments to play with.
I'd just wish he wouldn't try to moralise about his actions which were a) give MFC an advantage b) his personal beef with Mel Morris and c) his continuing objection to a charge DCFC were cleared of any wrongdoing over (sale of pride park) d) pressuring the regulator to "get derby or I'll get you' e) attempting extortion of a club in administration, and intentionally letting the matter act as an inhibitor to exiting administration and f) getting p&s rules changed to suit his club. Not to mention the borderline slander (don't worry I'm sure his lawyers checked the wording) contained in some of the statements
    Apart from that,top guy.

This as a defence just doesn't make sense to me. If it took "a huge amount of time and money" to prove that we were wrong, the bloody rules weren't obvious in the first place, were they?
With other loopholes, they have changed them retrospectively after clubs were found not guilty.
But with Derby they just appealled until they got the result they wanted.
The question now should surely be why did they spend such a huge amount of time and money on it?
And why do they need to change them if they were written correctly?
    No agenda against Derby? Pah!

I understand I'm pissing in the wind with this, just want us to be treated fairly which I feel we are not.
With regards to the review of our points deduction, I looked at the judgment and it was a loss of £1.96m above the upper threshold for 20/21 where a £5m covid exemption was allowed. Last nights statement was £2.5m with immediate effect to the 21/22 season.
Wouldn't change the deduction at all would it @Ghost of Clough?

It might be bloody-minded of me, but if Quantuma have (finally) been allowed to name a PB - after the EFL & Boro blocked it for 2 months, IMHO in a calculated fashion, and caused squad decimation and the prospect of liquidation, I'd be minded to decline the EFL bustards.
I hope the fan groups demand a prompt approval of the PB. And an apology.
The EFL fudged and farted their way along the transfer window, on strings manipulated by Gibson, until the damage was done and last-ditch interventions via MPs etc were required.
Maybe the EFL are now conscious of the attention that will turn upon themselves and they want to 'make friends' with fan groups perceived to be capable of wielding influence over the DCFC fanbase. No anti-EFL petitions, please, look how we solved it for you!

Yet again fans are looking for answers to questions and you’re trying to shut those down with information that you can’t prove, having caught up with the topic there is multiple examples of this.
You attempted to shut down my Football Creditor topic, an issue which is clearly relevant and been picked up on both by MP’s and the media, even yesterday one MP telling the EFL to tread very carefully as they could remove the Football Creditor status for everyone and forced to operate like a usual business. A threat that has come from the EFL’s insistence on us treating both Boro and Wycombe’s claims of football debt.
Regulation 4.4, a regulation which Middlesbrough’s lawyers sent to Mel Morris, omitting a key line that says only the EFL can take action, yet you believe the regulation to be a non issue as it’s just on good faith. Please explain why the Middlesbrough lawyers used that in their letters to Mel Morris to form their claim if it’s not relevant, have you seen the claim and have a better understanding of it than the clubs lawyers?
And here we are again, trying to say bilateral contracts exist between clubs, which again just isn’t true. This is true in the Premier League hence why it’s written for all to see, it’s also been seen in court with cases between clubs. Yet you will not find a single line of proof this exists from the EFL, nor will you have any examples of clubs suing each other in the EFL because it just does not exist.
Please, please, stop spreading misinformation whilst we as a community of fans within the fanbase are trying to find answers from the EFL, it’s not helpful and completely counter productive as we try to help save our club.

That tells you a lot though doesn’t it,  that we don’t know the details of his claim?
The truth here is not difficult to discern. Gibson and Morris detest each other. The reasons are lost in the mists of time and who cares?

But we, Derby, are now in the position where - but for these claims - our club would have been sold in January.

You say that Gibson has no desire to see Derby fold. You’re missing the point. The point is, his vendetta against Morris has pushed our sale back, he has trashed Rooney’s transfer window and he has put us at serious risk of liquidation. Our club is collateral damage in his nasty, squalid scrap and that is not acceptable to us. And I believe Gibbo also calculates that if he damages us, MM will be forced to pay for the repair, and he likes that. We see what has gone on and it is not acceptable to us.

All is revealed in Gibson’s open letters - cleverly drafted by his PR and legal team. They are disingenuous, misleading and largely irrelevant to whatever the claim might be. And with each letter, the goalposts move, now it’s FFp, now it’s the stadium. (Don’t worry, we know Morris’ letter is not much better.) There is nothing confidential in his claim, so why has it not been articulated in the public arena? We know the answer.

Even Couhig (whose behaviour is possibly even more revolting than Gibson’s) has had the sense to realise that to threaten a claim in these circumstances and without fully articulating it is beyond the pale.

The outcome here will most likely be that MM will put in place arrangements to indemnify the club, that those arrangements will remain in place for several years at significant cost to Morris and that the claims will never be brought. (Mission accomplished for Gibbo, the worst kind of playground bully.)  And that Couhig will slither away to begin another attempt to exploit some legal system or other.

Our owner has done a few shameful things in recent years. Nothing on the scale of what yours is currently up to

Its brave of you to come on. We all know the issues under MM's tenure - he conned us all too but the problem is we as a club have been punished so very very much by the EFL in various ways. Only Derby fans know the detail of everything that has been done.  So Unfortunately the "Derby are all cheats" line pedalled by your chairman and others saying we still need to punished more via these claims is why we have such a totally negative view of your chairman. We have no funds to settle a claim and having to do so will lead to liquidation - other creditors wont agree to a proposal where they get less. So SG's actions and soundbites do not reflect just how much we have been punished already by the EFL and how perilously close to extinction we are. You seem certain he will withdraw the claim when we get to the wire. We are across the wire in no-mans land in broad daylight wearing a fluorescent jacket and still he persists. So that explains our hostility to him

@BoroWill- the reason your owner is seen as the villain of the piece is because he is.  Not because of his views of Mel Morris and not because of his previous views and comments of our club's profligate spending - you will find many/most Rams fans (no doubt some late to the party) who agree with him on both counts - but because he is and has been for many months deliberately making it impossible for us to move to new ownership without us slugging him a considerable amount of money (anything between £7m and £45m) for a perceived competitive gain, when even your own fans believe that your failure to gain a play off place that season was largely down to Pulis and a sporting/player/results failure on your part.
We have been roundly punished by the EFL's processes for our financial splurge; we have spent the vast majority of the last 3/4 seasons under a transfer embargo; we've had 9 players leave this transfer window alone, most against their will; we're down to the bare bones from a squad perspective; we're likely to get relegated despite the fantastic effort that the players are putting in to avoid that happening.  Is not all that and more, punishment enough?
Yet, for your owner, this is personal.  He doesn't care that the club, our club, is suffering, that good people are out of work, that a fan base is suffering. The proof of that is that he is continuing with a claim that is at its very, very best, purely speculative.  If he relaxed his claim we could, probably, get new owners in place, sort out creditors, be relegated and under EFL control for two more years but at least move on.  He won't let us because he doesn't like Mel Morris and wants to see Mel Morris suffer. And that is it pure and simple, and that is why he is, whatever your protestations to the contrary, the villain of this piece.  It's time for him to show some leadership, move on and concentrate on his own club.

Will try not to bombard you with questions, but out of interest as a Boro fan do you:
    1) Believe that Derby/Morris owe Boro/Gibson compensation for the stadium sale, which gave us an unfair financial advantage?
    2) If yes to the above, would this not mean you are owed compensation by Sheffield Wednesday also, due to the fact they sold their stadium also and beat Boro at the Riverside.
    3) What are your thoughts on the EFL's handling of the situation and why Boro/Gibson chose to withdraw legal action against the EFL.
    ------
Looking at Boro forums there strong dislike for our club, which is bizarre as I found topics back in 2020 urging Gibson to drop the cases and you didn't deserve the play offs nor had any chance of going up.
Just from a personal point, I have nothing against Boro the club, which is you the fans, players and staff until you reach Gibson.
I can't speak for everyone, but imagine a few would share those views and when we say Boro, or revel in your defeats, it's purely aimed at Gibson and this legal action which we feel is ludicrous.

Maybe he doesn't, but it does appear that he feels that the Club (or perhaps Mel) has not yet paid a sufficiently high a price for the historical financial breaches for which they have accepted a punishment on.
Makes you wonder what is the price he'll accept - and I'm not talking about a monetary figure for compensation - it's all about sporting sanctions. So is that liquidation? Is it relegation? Is it the complete dismantling of the squad and a reset position so far down the scale that you need binoculars to see where you have come from?
  24. Clap
nick_d reacted to May Contain Nuts in The Administration Thread
He'll only accept it if it goes through the EFL's arbitration system, not a proper legal system.
If he didn't want our club to go out of business there would be no claim, or there would be claims against other clubs too. There would be no hiding behind EFL processes.

Long time since I posted on here but I logged in to agree that this is by far the most sensible solution that all sides should be pushing for. Morris is the root cause of your problems and our (and Wycombe's) ire. He shouldn't hide behind the convenience of UK company law to avoid having to fix the mess he made.
I'm aware that you will all have strong views on Gibson but I'm 99.9% certain he would support this kind of arrangement, he doesn't want your club to go out of business.
