    Rules changed 1/12/20 HMRC are now a secondary preferential creditor, see below.
    The Finance Act amends the Insolvency Act 1986 so that for insolvencies commencing on or after 1 December 2020, HMRC will rank as a secondary preferential creditor.
    The preferential status is for certain taxes due from an insolvent business, to include VAT, PAYE, Employeep NICs and CIS deductions – and will be paid after the primary preferential creditors for wage arrears and unpaid holiday pay.
    The intention is that more of the taxes paid by employees and customers will be recovered to fund public services, rather than be distributed to other creditors.
    HMRC will remain an unsecured creditor for direct taxes such as Corporation Tax and Employer NICs

    For the relevant taxes, this will place HMRC ahead of the general body of unsecured creditors with whom HMRC would previously rank alongside.

    For the avoidance of doubt I do not work at the State Department, I do however have some British Machinery in my plant which has needed urgent maintenance by the manufacturer and under their instruction I wrote to the State department for them to grant entry approval for a Brit to come over as it was affecting US Employment. The entry was denied leading me to look at all possibilities of getting a Brit over. I could not find any possibility. If Mel was a green card holder he would have to be resident in the USA and leaving the USA for more than 12 months would invalidate that green card, also HB1 visas grant the right to work in the USA which patently Mel does not.
    My view remains that the story about him being in the USA are BS

    Daily Mail article regarding debt, fyi read last paragraph with Mel comments about PAYE payments, also I can say that one of my business's easily reached an agreement with HMRC to pay VAT arrears over 12 months because of Covid. As long as you stick to the agreement they will not issue a winding up order, so HMRC is not at the moment a club killer.

    My remarks were not aimed at you and I apologise if it came across as such, my comments were aimed at the board in general whereby there is an almost total lack of understanding on the mechanics of a business sale and purchase, but posters pontificate on the subject as if they are experts.
    My final comment is that club did not have enough cash for wages in their bank account but as soon as Mel knew the situation he paid them, given this was over a holiday period he may not have been initially contactable for a variety of reasons.

    Businesses are normally sold on a debt free cash free basis with purchaser coming in covering overheads as soon as contracts are exchanged. They also would have to open their own bank accounts for the business which as we all know is very difficult with current money laundering regulations, it is clear a date for signing completion and exchanging contracts had been agreed and bank accounts emptied prior to that taking place. It is also clear that on the other side, the fake Sheik has a case to answer, although suing him like his own lawyers are doing, is probably throwing good money after bad. 
    Regarding due diligence although in this case probably due negligence is a more apt description, would NOT have been carried out by Mel and Pearce, the selling party on a deal as complex and large as this would have definitely been outsourced to an M&A specialist of which there very many, and I have lifted their sales role from a company I have dealt with in the past when selling a business.

    As you can see DCFC would not have the resources to do a full DD on the purchaser, it would take a specialist company to do it, therefore the comments about DD on here are misinformed and not accurate. 
    I think when all the dust has settled Mel will have a number of lawsuits outstanding, as he has been seriously let down by his advisors.

    From the EFL site regarding the Rams;
    Upon consideration, the Board determined that it would be appropriate to do so in these circumstances and offered the Club the following sanction, which was subsequently agreed.
    A suspended 3-point deduction to be immediately activated in the event that the Club breaches Regulation 63.7 (failure to adhere to the terms and conditions of an employment contract) on or before 30 June 2022.
    EFL site Sheffield Wednesday ruling which as you will see they missed 4 months of payments so not 3 points per month also looking at this ruling DCFC have paid wages up to date whereas Wednesday have not;
     
    In the months of March 2021, April 2021, May 2021 and June 2021, Sheffield Wednesday failed to pay their Players as per the terms of the agreements between the Club and its Players and were charged with Misconduct under the EFL Regulations.
    The Regulations permit the EFL to enter into an Agreed Decision with a Club in order to resolve disciplinary matters without them being referred to a Disciplinary Commission for determination.
    Upon consideration, the Board determined that it would be appropriate to do so in these circumstances and offered the Club the following sanction, which was subsequently agreed.
    1. A suspended 6-point deduction to be immediately activated in the event that:
        i. the Club fails to ensure that all arrears currently owed to the Club’s Players are paid in full on or before the 5 July 2021; and/or
        ii. the Club breaches Regulation 63.7 (failure to adhere to terms and conditions of an employment contract) on or before 30 June 2022
    Provided that the Club has not (whether by act or omission, intentionally or otherwise) failed to pay its Players again on or before 31 December 2021, from 1 January 2022 the sanction will be reduced from a suspended 6-point sanction to a suspended 3-point deduction which, for the avoidance of doubt, shall be immediately activated in the event that the Club breaches Regulation 63.7 on or before 30 June 2022.

    I missed the word overall in front of running. 
    My post was in support of Mel Morris who according to many document leaks on the internet had very serious health issues over the past 12 months including in one document which was headed as an "offer for sale memorandum"  which contained the statement that he was suffering from cancer earlier last year and undergoing treatment, I therefore get angry and take exception to assertions that he has gone missing has lost interest and is lacking in communication with a very hostile subset of supporters, all of whom appear to pile on without quoting anything other than their opinions which invariably are suppositions about conjecture.
    Give the guy a break.
