    That is how I read it, but I think there is the potential for a further 5 points based on how much we pay him and how much the total transfer fee is? (Based on percentiles of average premier league transfers and wages) I think if we shell out 5 million it is worth 3 points....possibly!

    Very naughty of me I know, but I tend to overtake them, then shoot straight over (dare I say "swerve"!) from lane 3 to 1, no indicating nor nuffink, in the hope it's a massive hint... it rarely is though, and like you say, they just continue to tootle along in lane 2, knowing full well that they will eventually overtake that lorry... a mile ahead... in a good 5 minutes or so!

    One thing I've noticed having done the best part of 10,000 miles on French Autoroutes now, is that the vast majority are very good at pulling back over to lane one, once the overtake is complete.  They get a bad rep, but from what I have witnessed, it is much more polite and civil over there... on the motorways, at least!

    Regardless it is uncomfortable outcome just because he is injured he is then sacked while Lawrence who has committed a more serious offence continues to be employed. Keogh’s lawyer would probably use this argument in his defence.

    We don’t know for sure what happened but the club do and they’ve decided to sack him so there was good reason with the facts they have. 
     
    There’s so much we don’t know yet people on here are slating the club and Mel - ridiculous.  How anyone can, without knowing the full story, get on their high horse is beyond me.

    I have felt too emotional about the whole situation to offer my view up to now.
    My heart is broken for a good captain and warrior for DCFC. To be sacked from the club you have given 100% to on the pitch over seven gruelling seasons must be humiliating and make you feel dreadful.
    However, my head now questions how much of Keogh's passion for Derby is real. The least favourable offer he turned down from the club, if accurate, of £3,000 per week, is more than the prime minister's salary and only slightly less than the chief police constable of Derbyshire who has responsibility for a huge budget and staff team  who do a tremendously difficult job every day at work.
    He was also being offered free state of the art rehabilitation facilities, could start to work on his coaching badges if he wished and presumably would also be free to supplement his income with appearances on Sky ("like you say") or other options if that is his choice. Most importantly in all this he was being offered an opportunity to retain his status as a good servant of the club and the adoration and support of the fans.
    He has chosen to reject all this for what? More money. Not much of a swap in my opinion.
    His action will now by actively costing the club too as they will have been taking expensive legal advice and will have to continue to do so over the appeal and possible tribunal.
    People are wondering why no official statement from Derby. I wonder whether the 'statement' we are reading is actually the dismissal letter to Keogh as the wording in it, including the 14 days' appeal time, reads like a letter from HR. 
    I don't know if I am being overly supportive of my club, but the whole way this story has broken makes me think it has come from Keogh's side. He clearly feels very aggrieved about the way he is being treated.
    I also think this will have been going back and forward for some time, that this is just the latest play from the club and that they might have been hoping for a response from Keogh that would have allowed him a successful appeal, rather than a messy, public and prolonged visit to an industrial tribunal.
    All this is huge speculation on my part, for which I hold my hands up. It is coloured by my huge love for our club, rather than for any individual player, no matter how good a servant he has been to DCFC.
    What I do know is that while Keogh still has my sympathy, he's lost my respect.

    Gross misconduct is being sacked for an offence seriously it requires an instant dismissal.
    Lawrence and Bennett have not been found guilty of gross misconduct. Read the DCFC statement, doesn’t refer to those words. If it did they wouldn’t be employed at the club anymore.
    Keogh is guilty of gross misconduct according to DCFC, hence he’s now unemployed (pending an appeal).

    Lawrence / Bennett: Personal gross misconduct but can still capably fulfil their professional contract.
    Keogh: Personal gross misconduct that made him physically incapable of fulfilling his professional contract.

    After about 6 years I am finally understanding this forum and possibly the wider general Rams fan.....why over 50% don’t seem capable of separating criminal law from (civil) contract law is beyond belief....even after it has been explained dozens of times on this thread! Although by pure definition, 49.9% of the population are of below average intelligence. 
    It doesn’t matter who likes what player, us, Mel, PCoc, we the public will only know what the actual ‘gross misconduct’ is, if the details are released. We will only know if Mason and Tom could have been sacked if details of the internal report are released. I would suggest a law student, HR manager or anyone with an idea for business could garner (with the facts) whether the latter has any bearing on the former.

    Most Professional footballers contracts will have clauses excluding them from 'undertaking high risk sports' but I am not privy to the exact wording. Taking part in the activity, skiing for instance can lead to the individual receiving a disciplinary action. The company will first investigate and the investigating manager will decide if there is a case for a disciplinary to take place. The disciplinary manager (I've done both in my company) will then investigate and decide two things, 1) Whether they believe he is guilty or not and 2) The level of punishment. The most severe punishment is gross misconduct which leads to an instant dismissal. The player could appeal this. So Keogh has been found guilty of gross misconduct whilst the other two have been found guilty but punished as far as they can without sacking them for gross misconduct.  Hope this helps.

    Your knowledge may well be of a higher grade, I only studied law for a year, this is however a civil matter and not a criminal one.
    My point about your confusion was merely down to your statement that the whole world knows what the gross misconduct was. The all encompassing terminology refers to specific wording in the individuals contract. It could be that Keogh has it written into his contract he has to provide one manic stare per match and at least 10 ‘umms’ in the post match interview and did not fulfill this. My point being you cannot determine what the gross misconduct is without specific knowledge of the termination or contract. 
    The clear criminal offences may not be determined to be gross misconduct, and/or there may be precedent already set by another employee of DCFC being convicted but not sacked. That would probably lead to an unfair dismissal case.

    I think 90% of the people on this forum cannot understand gross negligence.  It will also be why the club will suffer another backlash publicly.  We've already seen comments from Arter and Hendrick who are in public profile positions criticizing. Good job they are not paying the 1.7 million from their own pocket.

    The people on here banging on about consistency bothers me a little - unless they know all of the facts, in which case please let us know.
    There are many factors which mean consistency is over ruled at many different levels.
    My 6 month old dog shat on the kitchen floor and chewed through the phone cable the other day - got away with a mild ticking off, if my 12 year old dog had done it .....
    My 18 year old took my car without asking, my 12 year old took my car without asking.
    A murderer who shows remorse, pleads guilty and promises not to do it again tends to get a lighter sentence than someone who pleads not guilty, and swears that the DNA was planted, he wasn't there, it was his brother .... That is the rule of UK law, which has developed over 100's of years.
    To me Lawrence and Bennett have both gone down the "we will take whatever punishment is thrown at us!" "we did wrong line". Whereas Alfie Keogh is in complete denial and will not even compromise with a pay cut while not being able to fulfill his duties.
    If I had done what he has and my employer offered me a quarter of my wage to stay at home until retirement I would snatch their hands off. 
     
    And then apologize for snatching their hands off.
