    Statement in writing from the new owner that they commit to paying any costs arising from the claims. B&W agree to shelve those claims until the takeover is complete.  Would certainly force their hand if they're hoping to use admin to force a settlement rather than have to argue their cases in 'court'.

    You'd hope that after this they'll be a huge reform in who and how the football leagues are governed, and any fairy tale claims will die with the EFL.

    The EFL can't just dismiss the claims, but they can consider them not to be football creditors, which sends them down to the bottom of the pile next to myself and once the sale goes through it's settled. 
    Anyhow, leave all that for the other topic than get in the way of everyones Friday party in here, the administrators would be foolish not to take this offer on the table now, pack their bags before they change their mind on the bid than go down that path. They would be just as stubborn as Gibson which you would assume is highly unlikely.
    Never expected anyone just to take them on head to head, unfortunately though it doesn't give us the clear slate we all wanted, we would be in for months of headlines as it goes back and forth.....but we will have a club and thats the main thing right now.

    My concern with just shutting it down would be that there seems to be (to me anyway) no way under EFL rules to actually do that. If we exit admin and shut those claims down as part of it, what's to stop them just filing new claims? We know full well that there seems to be no vetting process at all over claims, you can file what you like. So we're gambling on a LAP saying that this claim has already been decided (when it kind of hasn't) to shut it down, and I wouldn't stake £50m on that happening.
    Let's see get it settled finally, if we can IMO.

    So the working theory is, that your owner is trying to force the liquidation of a founding member of the league, entirely because he has a personal issue with a previous owner of the club.   Surely that's the point where the right-minded fans start thinking, maybe our owner is in the wrong here, maybe he's more than a little unhinged, right?     The smooth brained of Middlesbrough might not be up to the advanced thinking of "Mel Morris being in the wrong to a large extent does not necessarily mean Steve Gibson's actions in this are in the right"
    And I think the realisation that "Steve Gibson could act differently for the benefit of others but chooses not to" isn't a mark of how "good" Steve Gibson is at things might just break their tiny minds.

    It's hard to quantify how much Gibson has a valid grievance, how much is his personal hatred for Mel Morris, how much is just a need to help MFC's books and how much he wants to see DCFC in ruins.
    But, the fact is, his actions are currently preventing a rescue of our club, he has entirely the power to withdraw, he is under no compulsion to continue and was under no obligation to take the actions that he has taken.
    If he, or Middlesbrough fans cannot in that context understand the rage towards him then they are failing as decent human beings.

    At the time, 'Boro's stadium was valued at just under £50m:

    For comparison, the EFL's written report had our replacement cost at £100m-£117m (that's the £86m in 'Boro's accounts), and used a lower amount of depreciation of 30%, compared to ~42% for 'Boro, to get to an overall value of somewhere between £77m-£89m.  So £22m was clearly nonsense.  At least part of the discrepancy is explained by ours being a newer and slightly better stadium.
    I should note that the 'Boro values probably include their training ground, and maybe even other its, but those are probably relatively small compared to the stadium values.

    This is what I don't get. That's certainly what he seems to want, but if the MSD loan doesn't get paid off in full, surely they just get the stadium? And then the whole deal probably falls though (because the bidders definitely don't want the stadium owned by someone else, and potentially sold on to who-ever-knows in the future). And then nobody gets anything.
    I don't see how he can force Mel to pay off the stadium loan?  Unless he's gambling on Mel to just step and pay to prevent MSD taking ownership, but I think we're well past the point where Mel is going to stump any major cash.

    I guess the question is, how much do MSD think the stadium is worth with no football club to play there.  The fact they seemed willing to loan us another £4m when went into admin suggests that (at the time at least), they valued it higher than the £20m they had secured against it already. But the fact they now seem unwilling to lend any more, suggests by not much more that what's secured against already (and I know circumstances have changed between September and now, so it's not a simple comparison).
