    Well you say it's sailed, but that didn't stop the EFL retrospectively going back over our accounts which they'd already signed off years ago because Gibbo threatened to sue them.....

    I still think the EFL are digging themselves into a deeper and deeper hole here, using a spade that Boro have forced them to use while they oversee the EFL shovelling away.
    In the League Arbitration Panel's ruling of 22nd October 2020, it is stated that:
    On 6 September 2019 MFC commenced arbitration proceedings against EFL contending that EFL had failed to take timely disciplinary action against DCFC. On 29 November 2019 MFC and EFL agreed that this arbitration would be stayed and EFL would commence disciplinary proceedings against DCFC.
    The key word here for me is 'stayed'. I did discuss this with a lawyer friend today and it does have the meaning that it implies of paused rather than stopped or terminated.
    Surely if Boro initially wanted to commence proceedings directly against the EFL for not taking action against Derby, and the EFL only managed to convince Boro not to do so by saying they would commence disciplinary proceedings against Derby themselves, then the action by Boro against the EFL would not be stayed but stopped. It implies that Boro will hold the threat over the EFL that they will restart action against them if the EFL doesn't pursue Derby to their liking.
    This point is also made by Mel Morris' letter today in which he says 'The root of this is that they are also under attack from Boro who basically said you pursue Derby at all costs, or we will continue with our action to pursue the EFL.'
    This isn't just MM ranting or paranoia of the EFL's stance against Derby, it is spelled out in this ruling on the EFL website.
    How possibly can Derby expect a fair hearing in any of the matters since the start of all this with the EFL actions clearly being influenced by the threat of a claim against them if things don't go Boro's way?

    Doubt either will take Mel on. Arbitration won't cost them a bean, win or lose. Lose in court and they'll spunk a small fortune.
    Also, let's face it curly git only wants the money for Boro so they don't breach FFP.

    Ok I've read it now.
    A couple of interesting points, but basically 3 pages of self justification and an offer that probably won't be taken up. I did say the MFC "open letter" last week had a lot of not relevant points, so does this.
    Interestingly Wycombe have just said we owe them money but not claimed it by way of proceedings...
    I'll have to go through and think about it more critically later.
    I do think However that this move from Morris does achieve a lot in terms of narrative, positioning and reputation, if Boro and Wycombe reject this, no matter how practical or justified the reason the wider world will see their continuing action in a different light.

    Now i'm not having a go here Asanovic70, just a bit of fun. In you last paragraph you say 'lack of leadership'. Lack normally means you are deficient in something, don't have enough of.....my personal view is that 'lack' doesn't cover it (far too generous), as it suggests there was some leadership, just not enough. Ther reality there is none, zero, zip, nadda, F-all leadership in the EFL.

    I didn't get the  Watford reference but then just found out the news about Ebosele. It gets worse. We're not even getting a fair price, if  that, for any of our players, the EFL are practically ensuring our youngsters are going for knockdown prices, rather than allowing us even to retain a modicum of a squad on which to (re)build upon
    Mel's to blame, but I blame the EFL for their lack of leadership in the current situation, and for allowing Morris to run the club in the manner he did.

    By bringing the initial claim they are accountable. Without the claim there is no obstacle to the sale(at least not from other clubs).
    Surely (and i'm guessing here) it's like making a fraudulant insurance claim when you claim you TV lept off the wall and damaged itself, when in reality you smashed it up in anger?

Neither of them should be entertained or included in any discussions. It’s about time Gibson’s financial dealings are scrutinised, let’s see how clean he is!
    The EFL are a weak, spineless organisation run by halfwits who I wouldn’t leave in charge of a kettle never mind oversee 72 football clubs. They are the babysitter you know you shouldn’t leave your kids with!
    It has to go to the High Court for a full adjudication, and yes there are potential risks with this, but it can’t be any worse than seeing our football club evaporate in front of our eyes.
    If we win, then we sue for damages against the EFL stopping us retaining our players and Gibson/Couhig for the same due to holding up the sale.
    The torture has to stop one way or the other and as others have said if these ridiculous claims of compensation based on fantasy are upheld, the floodgates will open.  I believe the EFL are done for as a governing body either way.
    The next worrying development I fear is Rooney chucks the towel in. How many more lies, half-truths will he stand for before he’s had enough?
    Regardless….. We fight to the end!
    Keep the faith my fellow Black and White warriors! I can’t support another club if we vanish, I’d be done with football.
