    The -15 point penalty is an EFL rule, and doesn’t need to align with the law. It’s a condition of membership for the league, which Derby have signed up to. It’s not based on law. The fact that the rules don’t align in certain areas doesn’t mean that all aspects of the EFL rules don’t apply

    I agree. And if people think the EFL won’t have the balls to apply a 15 point penalty if the minimum thresholds aren’t reached, then I would respectfully disagree.

    You are not getting it are you. Morris did overspend, and broke FFP limits, ultimately hoping he would get away with it by getting promoted. His spending in the Lampard era was his last big gamble, before deciding getting any of his money back via a sale involving that chancer Samuelson (was his best way out).
    As for taking Sheffield Weds position up with Dyson, I won’t bother thanks as I am still waiting for a refund from them on a vacuum.

    If everyone who used clever accounting to try and stay within FFP was actually guilty of breaching FFP then most clubs in the Championship will have broken FFP at one time. They’ve all done it. In fact Birmingham sold their ground too and that wasn’t challenged if you want to disallow that then they should have got done for more according to your warped logic.

    I am sorry this is utter one eyed drivel. Morris and Chansiri both completely overspent against FFP limits, and there was no attempt to 'stay inside' (other than by some not so clever accounting and/or (effectively) a fixed asset revaluation disguised as a sale).

    Not that it mattered. Morris decided he would bolster the squad with a huge outlay on Bielik. The man had lost the financial plot. Good job COVID came along though. Gave him a great cover story.

    The Forest ‘dodge’ needs to be looked at, but we would have breached P&S limits whatever FRS 102 compliant amortisation policy we used. The 9 points was for a significant overspend on net transfer fees and players wages, which no amortisation policy could eventually hide. Everything went on and on because Morris was clearly reluctant to submit any accounts for 2 to 3 years.

    I get the frustration, but that will never happen whilst negotiations are ongoing. It's annoying as hell, but nobody in the admin team or the prospective bidders is going to reveal their back stop position until they absolutely have to. I'm of the opinion that there's several different issues holding things up, but I have no evidence to support that.

    whether we'd be kicked out the league for doing it, or just given gazzillions of deductions and restictions for doing it.
    When they talk about EFL blocking things, it's the EFL kicking us out the leage that's the issue not f they can legally stop something.

    Agreed no, will have to lump it under insolvancy laws yes. EFL however could kick us out the league for doing it and we'd defo have -15 points. It has to be ordered by a court and can only be done if the judge is satisfied there's no other way.
    It's not a great plan TBH, but then, the main problem with DCFC is having more debt than it's worth.

    Under current circumstances, I'd be amazed at a fee exceeding a million, and I don't think that's even remotely likely. Is he worth more than that to Derby? Absolutely, but any fee received would never reflect his worth to the current team.

    Covid has killed the transfer market, no one is paying significant fees now. Most teams will be right on the line for FFP, look at Boro posting 35m loss in one season. Even if he still had 2 years left on his contract we'd still be looking at a bid of a maximum of 2m from a club with parachute payments.

    My biggest frustration is Mel.
    Whether it's more complicated for some financial reason (not going to pretend I know anything about laws/regs etc.) or not, it feels like he's just being a greedy barsteward.
    Not expecting him to do the right thing - but it looks from the outside as if he's being out right obstructive.
    Where's his statement? He needs to be brought into the light.

    I understand your frustration Mackworth, I really do, but I am not exagerating when I say that not only is this the most complex insolvency process ever in footballing history, it is probably in the top 10 of most complex UK insolvency cases ever in the UK.
    I think it was @Ghost of Cloughwho previously outlined the length of time insolvency processes took at other football clubs in the recent past. At not yet 5 months, we are not even at the average length of time on those previous cases (which I think was 9 months), all of which I can assure you would have been more easily resolvable than ours.
    Everyone needs to chill. I have no doubts Quantuma are doing the very best they can under the most trying of circumstances, with the eyes of the football world, media and Government upon them. They will want just as much as us fans to get a deal over the line to avoid reputational risk, indeed to enhance future business opportunity. I am sorry those still aiming their venom at Quantuma are misguided. They are in the sh!te because Morris has put them and us there.

    It's rather contradictory to argue that he doesn't know what he's talking when, according to other posters, he's to blame for tipping the EFL off about our non straight line amortisation policy when there accountants hadn't spotted it themselves! Can't really have it both ways can we?
    We're all unhappy about the situation the club is in but blaming Maquire is nothing more than shooting the messenger. Mel Morris got us into this mess - no-one else.
    His Price of Football podcast (with Kevin Day) is a good listen if you're at all interested in the business/finance side of the game. Having listened to most of them, the only 'agenda' him and Kevin Day have got is that they want to see clubs run in a financially sustainable manner and better governance across football has a whole. What's not to like? He's one of the good guys.
