Middlesbrough Football & Athletic Company (1986) Limited are suing Birmingham City Football Club PLC as well as former England international James Beattie, Sean Rush, Ryan Needs and Darryl Flahavan.

...

Promotion-chasing Boro fear that the quartet’s insider knowledge may give the relegation-fighting Blues a ‘competitive advantage’ over them.

Their knowledge of ‘confidential information’ includes transfer targets and strategy, player wages and weaknesses, Boro’s lawyers say.

Boro argue that a clause in the backroom team members’ contracts prevents them from working together, and alongside Monk, for their Championship rival until December 28 this year.

Fair enough if it's in their contracts that they can't work for the competition for a period of time. It's the norm in many industries - though in my experience is not often enforced.

Best they'd probably get is some money back from the individuals, and disrupt Brum ahead of the match, but they've no chance with the FA/EFL backing them up, it's possibly breach of contract but they're not going to see it as something that calls the integrity of the fixture into question.

Technically Monk and the rest of them were probably 'unfairly dismissed' and as such would have been given a pay off which would have been subject to a legally binding agreement.  Standard in those sorts of agreements are confidentiality clauses and agreements not to go to rivals for a set period of time.  Sometimes 'rivals' are specifically defined in the contract (eg any club in the same division); sometimes it's left more general.

What is interesting is that Boro have decided to pursue it (perhaps they want some of the pay off back) and that there was a clause preventing them from working together.

As always the only real winners will be 'mi learned friends' but the rest of the football world will watch on with great interest, especially agents of managers and their 'teams' of backroom staff
