    The agreed decision was brokered on the understanding derby would withdraw their administration points deduction on the basis of covid. 
    It must also have considered that the length of time it took to charge derby for the first year and how that impacted derbys activities in the subsequent years. 
    Personally think they need to do away with the agreed decision. Too much space for inconsistent approaches.

    Mel wants to put his beak in to protect his asset in Pride Park. Would like to see him formally protect the club against the claim and fund the legal action. 
    We need to remember that Mel has driven the club to near extinction and shouldnt be allowed near the club again.... but I do find myself agreeing with a lot of his statement.

    Tbh I think there's a lot of overreaction in this thread. 
    I don't think it's a surprise that the efl would deem the claims by mfc and WWFC as being football creditors. 
    Theres also no reason to think that the efl would (or even could?) change their insolvency policy. Particularly in a way that would be of detriment to their other members. 
    I suppose the real question is (and it would be interesting to know if there are other examples of this in non-sport setting) are regulations in a private league that restrict a way a member can conduct otherwise legal methods of exiting administration where the penalty of that is to be thrown out of competing in the industry. The league operates as a monopoly... There isn't a way Derby can really compete outside the FA/EFL framework. My gut feeling is that they probably can impose additional restrictions.

    Before we were even found guilty of anything I think. So by that measure any claim for any reason by a football club must be resolved regardless of merit.

    You have to remember, the charge was that the amortisation was incorrect/misrepresented.. Not that we were in breach of ffp - that came much later when we were in admin.

    The first thinking we have any sort of control about how administrators may run our club or get a buyer.. 
    The second, our good friend Mr P thinking that us as fans that might lose our club... Might have the audacity to consider ourselves victims rather than villains (!) 
    These clowns (and others) do real football fans a disservice. 
    We are as a fanbase embarrassed that our old owner didn't pay the debts... However we aren't going to accept going out of business as either a price we have to pay to put the fear in other clubs' chairmen and we aren't going to start grovelling and feeling remorse for our old chairman who ran the club as he did when we are ultimately the club bottom of the league, never got promoted, with a team cobbled together with a real chance of going out of business. 
    Just makes me unbelievably angry.

    Its always been like from the efl. People seem to think Derby never submitted accounts to the efl. I find this quite unlikely, I find it more likely that we never sent in accounts that the efl find acceptable.

    I'm starting to think that doing a deal with hmrc and 'dealing with boro, wycombe after' are incompatible approaches. Hmrc aren't going to like being told they can be paid £xm when a buyer is willing to be exposed to a higher loss from boro and Wycombe. 
    It does make me wonder whether boro or Wycombe have actually quantified their claim at all.
