    They are not answerable to me in anyway shape or form.
    You may think they are answerable to you, but they are not.
    Nothing pedantic about it, administrators are appointed to serve the best interests of the creditors, not the customers.

    The Administrators main responsibility is to maximise the return to the Creditors by what ever means that may take.
    (Hence possible 'fire sale' of players in January if no deal is agreed soon )

    Well actually the two times EFL tried to deduct points off us when Morris was in charge they failed both times. It was only when the admin team took over that they gave in without a fight.

    Your correct re Morris.   I still have absolutely no idea why he didn't clear liability and sell the club for a nominal fee to match the assets on the pitch, with a nominal payback of say 5 million a year for 6 years getting his final outlay back.  That could have been worth 25 million up front and 30 million over the next 6 years, or payment in full on any promotion.

    Gibson knows we don’t have the money to go to court. Once barristers get involved , the costs will go through the roof. The Bosman case went on for years and the lawyers got fat. His strategy is clear- Hold up the sale for as long as possible. Wycombe are just along for the ride.

    I agree with all of this except not sure how much choice Mel had in putting us into admin. does he have the money anymore? 
     
    and I certainly hope you are wrong about Boro claim liquidating us. The claim itself is rubbish of course but they could delay a buyer coming in which is absolutely not what we need.

    Where’s he getting his info. Presumably Stretford. Still seems like he’s trying to join the dots around the Appleby bid and he doesn’t really know. The Canadian reference could be Brett Wilson’s association with Appleby so he’s definitely scrambling on that.
     
    But confirms what we knew about Kirchner being outbid and that Wycombe and Boro are digging their heels in. If the preferred bidder is willing to take on the risk then duck em, take the bar stewards all the way to court and counterclaim the duck out of them! Bamfords!! 
    Looks like Nick De Marco could be getting some more work from us!

    My sentiments exactly but I also agree with Pistolpete, LazioW & David's additional comments re Admin.
    Yes Mel gambled big time and lost. QPR, Villa, Bournemouth and even Boro amongst others did the same and won. We made some awful costly signings for which Mel has to take responsibility.
    However putting the Club into Administration looks to be his biggest mistake. Far from crystallising the position it immediately handed the initiative to the EFL to impose dubious points deductions and too Boro and Wycombe to hold the Club to ransom. 
    What I would have loved to have seen was for Mel to take those three to court if necessary and fight our position. Something the Administrators will not/cannot do.
    Our amortisation policy was entirely legal and an accepted accounting practice we were just the first to introduce it in football. Just because Gibson threatened the EFL with legal action and Maguire highlighted it, asking a Club to rewrite/backdate it's accounts some 2/3 years later is just wrong. As the OP says in fairness Derby/Mel would have based the FFP calculations on those original figures.
    Mel should also have cleared the debts then selling the Club would have been easier. 
    Whats another £100m when you have already lost £200m ??  Then again it's not my money ?
    I fear now the Middlesborough claim could well liquidate the Club.

    2021 hasn't been easy for a lot of people, even tougher for us Derby County fans that have had to endure and will continue to do so the sleepless nights with the unthinkable, the threat of our club facing possible liquidation. 
    I just wanted to wish you all a Happy New Year, without you, this community would not be here, the community that has allowed fans from not just around the country, but the world to come together and help each other through these difficult times and I'm sure will continue to do so through next year and beyond.
    For any players, management, staff, anyone connected to the club that may also be reading this, Happy New Year to you also, I can only speak for myself, but I'm sure many others will agree, you are all making us so proud to be a Ram, we cannot ask anymore from you.
    Let's all go and smash 2022 ?

    I don’t understand why we are all so keen to blame Mel rather than the EFL. 
    The problem with laying the blame at Mel’s door is that the logic just doesn’t add up.  It relies on 3 pillars:
    Mel is as thick as mince He actively decided to ruin and devalue an asset he owns He is some kind of agent who intentionally bought Derby to ruin it. Let’s assume for a second that Mel Morris is neither stupid nor intent on ruining the club he supports, then you really have to ask – how does any of it make sense?
    There is an alternative narrative to the ‘Mel ate my hamster’ view of the world. What he did during his time was try to get us promoted by sailing as close to the limit of FFP as possible, just like every other club with a reasonably minted owner.  Where he massively failed was in not having the foresight to build a time machine.
    When we submitted the financial figures to the EFL on 30th June 2016 the EFL signed-off on those figures. As a result Mel based his future spending plans on how much he could put into the club while staying within FFP using that method. He funded the club on this basis for the next 3 years, without a murmur from the EFL.
    Let’s say that the EFL had been even half-way competent – it’s a stretch I know, but bear with me – and had said on the 30th of June 2016.
    “Mr Morris, we don’t think you should amortise in this way, can you resubmit using the previous method?”
    What do you think he would have done? Given that he’s not stupid or intent on ruining the club I’m betting he’d have said:
    “Right you are, I’ll change my plans accordingly”
    And over the next couple of years sold Tom Laurence and not bought Krystian Beilik.  From the figures that have been quoted I think would have been enough to comply with FFP, and if it wasn’t he would have sold someone else, wouldn’t he?  Given the alternative was to destroy a really valuable asset he owned I don’t think that is an unreasonable assumption.  I would argue the EFL retrospectively moving the goal posts and a global pandemic that disproportionately hits the best supported teams are why we are where we are rather than the blame all laying at Mel’s door.

    You appear to have missed a very important piece from your jigsaw.
    I am sure that you will remember that the EFL go an INDEPENDENT Disciplinary Commission to review the alleged rule breaking.
    The outcome of that and the EFLs decisions to ignore the findings is a major part in how we ended up where we are.

    The winding up order in January 2020 was withdrawn after a few days. The bill was settled, so that's a non-issue. The current bill is due to the lack of income during the pandemic lockdown and reduction in income ever since. The admin team have estimated a funding gap due to COVID of between £30m and £40 m. are they rewriting history?
    The notes to the accounts in 2016 made it clear we had changed the amortsiation method and if anything EFL thought we were using a more non-compliant method than were actually were ..using non zero values for players who coudl leave on Bosmans .  So if they were misled they were misled into thinking we were very non-compliant when we were not. So why didn't they bring action earlier? There really is no excuse for the EFL to be ducking us around like that. Your stuff in bold is itself very misleading and wrong.
    Also the EFL redid the accounts for us , we accepted their redone accounts just to bring it to a close doesn't mean their accounts were any more right than ours. They do not have a duty to seek  penalties for potential breaches (or even actual breaches, necessarily) , they were just throwing mud and hoping some would stick. And they were seeking to relegate us if they possibly could any which they could.  
    So that's why the fans are still singing "duck the EFL" and really hoping that we can overturn the 21 point deduction, stay in the Championship and really stick two fingers at them.

    When Mel went public with his intentions to sell, I made a suggestion, write an autobiography when this is all over, and I hope he does once the dust settles.
    What happened, what was the tipping point that saw him pull the plug, how did we manage to rack up this huge debt to HMRC when Fawaz down the A52 was facing winding up orders every couple of months.
    Whilst ultimately his decision cost jobs, left behind a lot of debt to local businesses, which I am a creditor myself, leaving the existence of this club in jeopardy, I can’t sit here today and lay all the blame at his door, of course he must accept his part in this, not suggesting for a second he completely blameless.
    Being a long time supporter of Mel, I have largely avoided discussions around him as there are still questions that I feel need answering, more clarity of what went on, closure. It would be easy to sit here and call him all the names under the sun, but I feel like I owe him the opportunity to explain, I hope he does find a way as his final Radio Derby interview didn’t really explain anything we didn’t already know, no gaps in the timeline were filled, and it’s those gaps which have left so many questions.
    Do not think I am here to defend Mel, only Mel can defend himself, I have no intention of getting into drawn out debates as it will only cause more anger and frustration when right now we should be focussing on the future of this club.
    You can drag up posts from the past that I and others made, but they were made with the information that we had at the time, others that raised concerns, had their doubts whilst hurt may feel smug with “I told you so”, which is their choice. I have made my enemies just from running this platform, sure there’s a few out there finger pointing.
    However Mel came in, spent money, created excitement and dared us to dream which is exactly what football fans want, we had no idea it was ever to be a poo or literally bust, we were led to believe that we were on the line, pushing it at times which many clubs do, but that line was dragged out of reach when the EFL decided to review our accounts over previous seasons, accounts which they signed off.
    I still to this day believe that EFL, Boro and Wycombe must also take some responsibility in all this. I also don’t think we can just ignore the impact that Covid has had, both financially and personally. Mel did not have a crystal ball, for all this to come at a time when trying to sell the club placed a fuckload of barriers in the way.
    Whilst you can argue you shouldn’t live life on the edge, be prepared for the worst, I have been around 40 years and this is the first global pandemic which has changed life as we know it and seen sporting events played behind closed doors. Over the next 12 months I’m sure we will see others start to show the impact that alone has had without the EFL on their backs.
    His own health issues which remain private and may not have played no part in his decision, but many things happen in life that can make you question your own mortality, did his, was his primary concern his family where the outside abuse questioned his financial support? I honestly don’t know and not trying to manufacture excuses here, losing close friends, illness, it can and does make you question where you are yourself in life.
    I don’t know if we will ever see a book, if some already feel they have closure and wouldn’t be interested or believe a word he says, I for one believe it would give closure those that supported him during his tenure and feel hurt with how the club has been left, all the memories which should have been left have now been tarnished, including the one at Elland Road.
    Life does go on though, I'm not going to spend another day questioning why as another mental drain that I have no desire to entertain.

    A strange meltdown by Maguire on Christmas Eve.. first an over the top rant against Kirchner, and then a twitter spat with a Rams fan.

    I mean I agree with Maguire that Kirchner was a bit of a time waster and showed a lack of class with his tweets. But so did Maguire show a lack of class, no need for that.
    As for his spat with the Rams fan, I agree with the Rams fan it seems Maguire is biased against Derby. Doesn't help having a character like Couhig on his podcast. Odd that Maguire is saying he helped Derby's defence. In a strange way he did , because his tip off shows that EFL couldn't have been unaware of our amortisation method. They were anyway of course, it was in the notes to the accounts but Maguire just highlighted it, but a strange  way of "helping" us .

    One of the main sticking points is the post takeover potential for Boro and WW to continue their pursuit for damages. Until that is sorted nothing will be resolved. Liquidation may be the only way to guarantee they cannot continue, as a reformed club would not be liable. However, the reentry point to the football pyramid would also be a critical negotiation point with the football authorities.

    Folk need to remember that the administrators have to follow a set process and are bound by rules that ensure they do their best for the creditors (not the fans!). If they breach those rules they’d be in deep do-do with the authorities and wouldn’t be able to practice again. They’re not allowed to drag the process out to line their own pockets (as some are suggesting), they’re not obliged (or allowed) to make all of the details of bids public, nor are they allowed to sell the club to the loudest bidder just because some supporters think he’s the messiah…. If we end up going bust, it’s Morris that’s to blame, not the admins….

    I disagree, it's very clear that when CK discovered he wasn't going to be the preferred bidder he improved his offer. That will, obviously, have delayed the naming of that bidder as the administrators would be duty bound to hear that improved offer. It never feels like positive news when somebody drops out like this but if you read between the lines it's encouraging.

    It strikes me that some of us are forgetting that the administrators primary responsibility is to get the best deal for the creditors. If, as you seem to be implying, they have rejected Kirchner’s offer in favour of a much lower one then they would potentially be displaying dereliction of duty. 
     
    None of us know the full details of the various offers and seem to be making bold statements based largely on speculation and Twitter posts. 
     
    As each day goes by I get more and more concerned but, if the administrator has allowed Kirchner to walk away without announcing him as preferred bidder I suspect there must be a good reason.

    Total lack of class from Kirchner. Haggling via socail media and via the Sun newspaper and then having a hissy fit when he isn't the preferred bidder. Reading some of his tweets he does remind me of Alonso, although maybe at least Kirchner did actually have money but looks like he has been outbid.
