From the answer that Q gave to Rams Trust
The position with HMRC remains unchanged and has been covered in multiple previous meetings. They have requested an update which we will provide shortly. However, as we have previously advised, we have shared our draft proposal with HMRC which covered various scenarios. They were happy with the principles in that draft proposal. As previously advised, HMRC will not give formal approval to any proposal before it is in final form. We will provide that proposal once the preferred bidder is chosen and the exit strategy is confirmed.

You are correct, football creditors come First but it meant that HMRC can demand 100%.
Now things have changed it seems liquidation is more likely than previous if new bidders aren't prepared to take the vast majority of debt on.

I haven't seen any other clubs offering support with our plight and it has now been raised in parliament, how do you think other owners will react if we were only to pay 25%. They will be getting on to their MP's wanting to know why HMRC have not pushed for the full amount as the rules have been changed specifically to prevent that. We have Several MP's backing us but that leaves over 640,many of whom have EFL clubs in their constituencies, what happens if they start raising the matter with HMRC. They won't give way to save the club if the majority complain. It became political when the issue was raised in parliament.

MP's cant do a thing about it even though they like to think they can, they are just paying lip service to be seen as doing their best.

I would suggest that while £7.5m is not much to HMRC, it is quite a lot to the thousands of households facing a cost of living crisis while their payments to HMRC go up too, who might not appreciate them foregoing £7.5m to make a point about the one football administration we get maybe every other year.
The debt should never have been run up, but now it has I think it is HMRC’s duty to be sensible about things.

    Yep, it`s a conundrum.
My personal opinion is that 25% is not acceptable to HMRC. As I previously mentioned, they are out to stop Football Clubs using Administration to reduce debt. 12 points is a small price to pay to lose £20m of debt.
As for a longer term repayment, yes I agree, and that is alluded to in the Morton Fraser article. The fact it`s 3 years old is irrelevant, that`s just when the landscape was changing.
However, if a longer term payment of say 75% of the debt is acceptable, it`s a huge ongoing commitment for any new owner and straight away loads the overheads. Lets say 5 years is agreed at say £4m per year (will interest be applied too?) that`s a huge additional pot of money to find for any club, but particularly if that club is now in L1 with massively reduced revenue, with a full squad to fund and £1.25m per year to rent a stadium then the business plan looks very different.
That doesn`t look like a Mike Ashley purchase to me.

    As you say, speculation.
But based upon what I`ve read and heard, I see this as the biggest obstacle.
We know bids have been made, but for whatever reason no bid accepted / preferred bidder named. Why?
All I can see is that the bids submitted don`t satisfy the necessary requirements and/or values to move forward.
When you look into the level of debt, the assets, the complicated structure and the short term investment required to get the club moving again, the Club makes no sense as a business acquisition. (To me)

25% to HMRC is roughly £7.5m. Would HMRC take a £7.5m hit to send a message out to the Football World, that never again are Clubs going to be allowed to use Administration to reduce Tax Bills?
My understanding is that is why HMRC was upgraded to Preferential Creditor status in Dec 2020.

I don`t think a PB will / can be named unless there is a bid that comes anywhere near achieving a CVA.

Could never see Rooney leaving mid season however once the season is over whether we are still in the championship or League One Rooney may think he has done his job. What he has achieved this season will not have gone unnoticed by other owners.

How does the value of the club actually change when the £28m is there to pay off debt? That £28m bill is there regardless of the division we are in.
Can anyone explain this in a way I've not understood it?

The EFL is waiting for Derby's relegation to be confirmed - and then Parry The Pariah will adopt his Messiah persona to declare that the EFL has granted DCFC permission to make a PB  announcement. All a matter of timing to appease Gibson and others.
Meanwhile, as Everton slide into deep sh !t, and suffer relegation, they beg Rooney to leave Derby in the summer to lead their bounce-back campaign!

Remember him saying to a Polish paper when he signed he wanted to back in the premier league in two years.  That certainly ain't happening so League 1 is out I reckon.

The article says a further points deduction would be applied next season if Reading fail to comply with the agreed business plan but the Barnsley chairman is saying "Barnsley are at a competitive disadvantage NOW".
Does that mean Barnsley know the details of the agreed plan and also know that Reading are failing to comply?
If they don't know then there is no case to answer at the moment but there could well be a Wycombe scenario (although they'd have a more valid case given the offence actually happened this season) next season now the EFL have allowed the can of worms to be opened.
If it is true Reading are not complying then I'm not sure why the additional points deduction shouldn't be applied immediately.

We have enough loot to see the season out, 2 scenarios, PB comes in takes us over and we move forward, or no buyer and we're liquidated...in that case why would players sign when they don't know what the MFer is going off?‍♂️

Because that funding is to see out the fixtures, not pay off debts. You cannot take on more debt, which by giving out contracts, you will be committing to. In real terms, we should be paying our bills first.

If Rooney takes another job, good luck to him.
I think the reason why Lampard and Rowett were condemned is because they left jobs unfinished and left the club in the lurch.
Rooney? I think he has given the job everything and no-one would blame him for taking on a different challenge.

People won’t be talking about relegation to League Two, but I think that’s due to complacency.
If we go down we’re realistically going to lose pretty much all of our best players, and we’ll probably be suffering from the stereotypical relegation hangover. I certainly don’t think we’ll bounce straight back up.

Even if it were true I don’t think anyone in their right minds would believe league 2 teams could go into liquidation, reform, and remain in L2.
I don’t know what criteria they use (in Macclesfield’s case for example) but I assume the principle is that the Phoenix club has to rejoin the pyramid at a much lower level.
