Ken Tram reacted to duncanjwitham in Steve Gibson trying to liquidate Derby
The obvious question with that is, were 'Boro trying to make the EFL enforce their rules, or trying to make them enforce a particular interpretation of them that favoured 'Boro over us? It certainly seems clear that in what 'Boro deemed to be the major issue (the stadium sale), the interpretation that the EFL initially applied was correct (that the sale was allowed).

I`m pretty sure it would be 1 league down from the conference, so probably Conference North.
I read somewhere that whilst other Phoenix Clubs have started much lower down the pyramid, none of them are close to the size and fanbase of Derby and any clubs lower than this would simply not be able to cope with the amount of away fans that we would take.

Ken Tram got a reaction from Dean (hick) Saunders in Steve Gibson trying to liquidate Derby
The EFL should compensate Middlesbrough.
Middlesbrough were right - the regulation was not fit for purpose - EFL were in the wrong.
Derby did not blatantly break the rules. The arbitrators found in our favour - which was overturned by appeal.
We have had a sanction, within the rules.
I think I'm saying that Middlesbrough were not wrong to try to put an end to poor regulation. Everyone agrees with them. The regulator should take the hit, rather than singling outa whipping boy.

If liquidated, which tier could we realistically restart in?
Are we allowed to keep the same name?
(It's not what I want to happen, but I'd like to know the threat.)

Being British, part of me would prefer that to giving in to Middlesbrough.
The other part would prefer a compromise to make the problem go away.
And the hopeful part hopes that the unfounded claims melt away!
I think that the size of my parts will fluctuate as we head towards the end of January!

I think it's been said on here to be something like the 4th or 5th none league tier.
The rights to the name *could be bought as part of the liquidation but the new club would be a new club not a continuation club. Although we could just cry that it is until everyone gets board of the argument like rangers did.

Find ways to fund the club until the end of the season and fight them in the courts.
If we have to pay the claims we are as good as dead anyway.
Better to go on or go down fighting.

So, no one is shifting but the government underling representing the Department of Culture, Media and Sport has suggested everyone works to find a pragmatic solution. So I thought we could all offer ours - please not just telling Gibson that's he's a right bamford and should duck off. We all know that but he won't, so we need something that will work:
to save the club hopefully in time to keep our players and manager to give them a shot at pulling off the "great escape" So, here is my suggestion to kick things off.
----
Gibson, Wycombe and the EFL will not backdown - they need to save face. None of the potential buyers are willing to take on the club while there is the risk of payouts of unknown dimensions --> Impasse
(Aside and first up, I do not want to give Gibson a penny but we have to be practical remember)
So....
We agree to go to arbitration to settle the Boro and Wycombe "claims" However, so that we can complete the takeover promptly, all three clubs agree a maximum amount of "winnings" (we can win costs). I don't know an amount, say 5 or 10 million in each case. That gives certainty to prospective buyers of the club. If Derby were to lose at tribunal (who knows, I don't) then at least the buyers would know the maximum that they would have to shell out. They can then decide on that basis whether they're in or out regards bidding for the club. We can all move forward. Hallelujah -

That is my fear. Any issues could potentially lead to the club receiving a large fine that is really not helpful to our cause.

True.
As much as I wouldn't mind if the Derby fans absolutely wrecked the place, now is not the time for that. Any excuse for the media to run a negative campaign against us they will jump on it and the minute we lose sympathy our fight weakens.

Suspect it may all boil over at Boro away. Large nos of fans without tickets + large numbers of police + provocation = trouble. Derby fans need to use their heads. Suspect police will remove fans from “private property” of the ground if they’ve no ticket. Needs to be organised, noisy, disruptive but peaceful.

His promotion bid is dead. They have broken P+S rules so the team in 7th is going to sue them
