It is making allegations against directors in their roles as directors, not pursuing them in a court of law after they have stepped down from a limited company. There really is no connection whatsoever.

I'm not sure how this is relevant to what you asked? It was DCFC and their directors who did this. That doesn't mean Gibson could pursue an owner/director who has now stepped away from a limited company.

Sorry but nothing in this statement says the claim is against the directors as individuals, it just accuses the directors of facilitating cheating as directors of DCFC (i.e. within that role). It’s very hard to claim against an individual for something they did as a director, unless its criminal behaviour.

There is no legal method for Gibson or Middlesbrough to personally pursue Morris over this. Mel Morris knows this and thus his offer is completely vacuous. If Mel Morris would like to indemnify any claim for Derby County then I'd imagine the offer would be accepted instantly.

Thanks for the reply, I'm really not here to have a slanging match or an argument. I've been following this thread for a while and just wanted to log back in to try and give a bit of our side, which I hope I can do.
1) No, despite the clearly inflated price the stadium was sold for this was deemed to be within the rules by the EFL even after appeals. If we have an issue with that aspect we should be pursuing the EFL.
2) See above.
3) I think the EFL have handled the situation terribly since the start (and I mean the end of the 18/19 season when they had access to your accounts that have since been found to be against the rules). As for why Boro/Gibson dropped any action against the EFL, I believe the prospective case was about them not enforcing their own rules properly. By giving you a fine and points deduction that would make our case pointless as at that point they have enforced their rules.
I think the dislike towards your club/fans (which I don't share) stems from a few things. Since 18/19 a number of your fans on social media revelled in the fact that Mel Morris had the whole league "on strings" and could do whatever he pleased, when Gibson originally raised his concerns over your spending these same people aimed abuse and mockery at him. As I'm sure you're aware, Steve Gibson is extremely well liked by Middlesbrough fans, so seeing him take abuse for pointing out that someone was cheating definitely got a lot of our fans backs up. Seeing him now being portrayed as the villain by many who also drank Mel's kool-aid is pretty irksome too I'd imagine, he told you that you were cheating, he told you that Mel was a liar, and now he has been proven correct he still gets abuse.

It would seem to me that the final paragraph is exactly the action Q propsed to the EFL on that fateful Thursday in mid-Jan. The EFL said something like, go-ahead with your statutory powers, but dont be surprised if the Rams won't have a league to play in if you proceed on that basis.

I’m saying MM is fully aware his offer to be sued in the High Court is legal nonsense and cannot be taken up. And he is aware that if it is not taken up it, it weakens Gibbo’s criticism of him
these open letters are a distraction, and a waste of valuable time - MM needs to indemnify the club against the claims

There seems to be some misunderstanding of the EFL's position on all of this. So, to my understanding this is where they stand...
Any disputes between clubs have to go through arbitration, no independent legal action against each other of anything. The EFL do not get actively involved in arbitration, other than setting the basic ground rules. They don't review claims, block illegal claims or anything. They want to be completely independent of it all. If claims are illegal (i.e. against EFL rules), unfounded or whatever, that's a matter for the arbitration panel to decide at the time, not the EFL beforehand. Any financial awards resulting from arbitration are football debts. All football debts must be paid to exit administration and remain a league member. Claims cannot be squashed out of existence (or anything similar) as a result of exiting administration they need to be properly resolved through arbitration or settled/dropped outside of that. Basically they don't want clubs to be able to escape from paying genuine football debts by insolvency policy trickery. Not saying I agree with all of that, but I think that's what they're thinking.

(Haven't yet continued my catch-up from the above post onwards, but wanted to divert myself for a moment... so apologies if this is out of order)...
As a very good friend of yours, @Curtains... albeit by sheer coincidence, also a complete stranger... May I suggest you take a breather. In good old Rams related fashion, maybe 48 hours?
It is what it is... heart-breaking, as you say... and there's virtually nothing any of us can do about it, other than the odd march, and the odd full house on a matchday, and who knows, maybe even the odd doorstep protest in Preston, in the weeks ahead?
But what we can all do, is take a step back when we need to. We can (and must!) retain our health... mental & physical... and our sanity (The latter being subject to T&C's, obvs!).
Yes, we are powerless. Yes, it's extremely frustrating. And yes, it can be traumatic at times.
But we must not lose sight of the fact that we must also remain strong. We must look after ourselves... and our loved ones... over and above anything else. And that includes our long-time favourite football club.
Take a break, buddy. And take care of yourself. ?

Which is why MM will forever be the villain of the piece, because he chose to declare DCFC insolvent as a "strategic" move to force a sale. He did not have to do that
