As Birmingham council made no provision for this huge compensation claim which ultimately was their own fault then this effectively left them borassic. So is the implication that they are declaring bankruptcy as a way to avoid paying up on this legal liability?

Birmingham councli were aware of this potential huge liability ten years ago when it all surfaced and made no provision in their accounts on a year by year basis since then in case they would have to pay out. It's caught up with them now, I assume they were hoping that they would win the case but sadly we're either misinformed or just deluded.
