    If he thinks we should have gone into administration last season (and therefore incurred a points deduction), I would assume the defences would be: none of our creditors took action to put us into administration and Mel didn't because of the numerous ongoing takeover negotiations that have now collapsed. I fail to see what case he have against the EFL - they have no control of when we go into administration.

     

    What happens now depends on what is uncovered by the administrator. No one knows what went into the compilation of the accounts, is/was there anything being hidden to be frank. LOL! As fAr as Wycombe having recourse against the EFL is between them, not anyone’s problem except theirs, but they will be making the EFL justify decisions over Derby in the light of the current circumstances, which is what I would be thinking..Then it’s all about if they can on the balance of probability show improper procedure or conclusions  

    What will likely happen is suit will be filed against the perceived plaintiffs whomever they may be What happens next is something called discovery then it’s all up for grabs, make no mistake. I would be expecting that sooner rather than later

    Discovery, in the law of common law jurisdictions, is a pre-trial procedure in a lawsuit in which each party, through the law of civil procedure, can obtain evidence from the other party or parties by means of discovery devices such as interrogatories, requests for production of documents, requests for admissions etc

     

  2. Anyone can sue anyone that’s for sure. Sheffield Utd got considerable damages from West Ham a few years ago, for a much different scenario. However the rub is this. The administrator will be looking deeply at how The club got to this point. If there any new conclusions drawn regarding, GAAP and how far the financial mismanagement went and who knew what when, then yes I suspect Wycombe Wanderers will file against The Rams (notionally making them a creditor) and The EFL. 
     

    Also there is now an implication that the board and directors of Wycombe may have a fiduciary duty to do so in some circumstances.

    No, the best thing for the football club would be him paying the debts of the football club and to find an agreement with the EFL. The best thing for him was to put us in administration, therefore taking the workload and liability away from him. 

    As it stands, we've incurred an additional -12 point deduction on top of anything else that we may pick up and seemingly something that could run for a few more years yet. Another story ran over night thinks we're due to receive a -21 (potentially another 3) this season. With a further 15 point deduction next year. We've also got a transfer embargo for two years. 

    We know that Buchanan, Bird, Sibley and Knight will be sold. I'm not too concerned about that as I think it's great they're getting out of this mess as they genuinely have a career and a lot of potential. As a Derby fan, I wouldn't want the club to be a weight around these young lad's neck and become the reason they didn't fulfill their potential. 

    Mel is the worst chairman this club has ever had, he's leaving the club in the worst mess its ever been in - arguably up their with one of the worst messes of any club in the history of the sport. A club without a stadium, which he owns, potentially soon without training facilities huge point deductions with severe transfer embargos that could sink the club into the League Two - similar to Bolton. I think they still own their stadium(?) although I'm not sure. 

    But.... he's doing it for us. What a truly wonderful guy! 

    Yes that sums it up from what I can see. The issue will be that without assets Derby are not worth buying in the normal sense. The ground being separated from the club means that Derby County FC only have player values and their Championship status that  “could” be considered assets and as such shrinks the buyer pool to ridiculously rich buyer or entity. Anyone interested in taking over the club will want to buy the ground which would be a separate but associated deal with the stadium grounds owners. 
     

    The timeframe is then the issue, unless their is someone or entity that is already in negotiations, it will take either months or not happen at all. Mr M has done what any sane business man would do, spread his risk buy dividing fixed assets from the FC. THUS he will get at least some of his money back for the dirt/stadium. 
     

    What bothers me is all the bluff and bluster of the ongoing wrangle with the EFL has now shown what a mess was being covered up with the accounts. The Board of directors of the FC have a lot to answer for as probably do the directors of the stadium, as if you don’t think the administrator won’t be trawling over every detail to see if they can distract money or void the deal you are dreaming. COYR

  4. The obsession with accounts is clear, however the issue is cash! Accounts can be made to say anything, that’s why you have accounting standards, but cash is king. All businesses die not because of anything other than cash flow! What Derby have at bank and what can be raised above that will be the determining factor of the coming weeks and months. 

  5. As a supporter of another club, this is how I see it!

    Rotherham’s late equalizer has probably given them a lift for the Tuesday game against Luton (away), who have nothing to play for. Its highly likely they will get something, there....Then its all about the last day!

    Sheffield Wednesday look awful. Bannon is a bit of a one man team and they are mistake riddled.

    Rotherham if they beat or draw with Luton will throw everything at it on the last day.

    I guess its a matter of whether WR can get enough out of them to beat what I see as the divisions worst team currently (outside of Bristol City who are terrible right now but obviously not in the equation) 

    Anyway good luck, its going to be a long effing week for Derby fans! Tuesday will be huge! There is upside to a Rotherham win at Luton and that’s it almost certainly relegates Wednesday even if they beat Derby...That will be deflating!
