What Gibson did was not explicitly against the rules at the time, but was obviously against the spirit of the rules. The EFL subsequently closed the loophole by adjusting their rules. What Morris did was not explicitly against the rules at the time, but was obviously against the spirit of the rules. The EFL retroactively changed the rules (because of pressure from Gibson) and charged us, which led to where we are now. Spot the difference?

That's not my understanding - they could pursue Morris under novation, which is different in nature to an indemnity. In essence it releases the club from the obligation of settling any potential debts (instead of Morris paying them back at a later point) - I'd argue given Morris' track record, it's probably the safest method for DCFC & indeed Gibson/the other one to collect any awards should they win their cases.

That said, we all know Gibson isn't really interested in his day in court. His sole intention is to apply what he believes is the correct form of punishment & what the EFL openly asked the DC to deduct points for back in May - our relegation. The delays, the relentless bullying of a pretty compliant EFL, the conveniently timed media stories and leaks are all designed to unsettle the club so the potential miracle of Rooney keeping us up never happens.
Its cowardly, immoral & totally disproportionate to the 'crime'. We have been found guilty of one thing - applying an amortisation method that the EFL retrospectively disagreed with that was signed off by independent auditors & submitted to the EFL at the time. That's it. The spending was actually less than Boro & other clubs during the periods in question & nothing maliciously aimed at one club.
Nothing personal by the way & thanks for coming on to explain your POV.

@BoroWill- the reason your owner is seen as the villain of the piece is because he is.  Not because of his views of Mel Morris and not because of his previous views and comments of our club's profligate spending - you will find many/most Rams fans (no doubt some late to the party) who agree with him on both counts - but because he is and has been for many months deliberately making it impossible for us to move to new ownership without us slugging him a considerable amount of money (anything between £7m and £45m) for a perceived competitive gain, when even your own fans believe that your failure to gain a play off place that season was largely down to Pulis and a sporting/player/results failure on your part.
We have been roundly punished by the EFL's processes for our financial splurge; we have spent the vast majority of the last 3/4 seasons under a transfer embargo; we've had 9 players leave this transfer window alone, most against their will; we're down to the bare bones from a squad perspective; we're likely to get relegated despite the fantastic effort that the players are putting in to avoid that happening.  Is not all that and more, punishment enough?
Yet, for your owner, this is personal.  He doesn't care that the club, our club, is suffering, that good people are out of work, that a fan base is suffering. The proof of that is that he is continuing with a claim that is at its very, very best, purely speculative.  If he relaxed his claim we could, probably, get new owners in place, sort out creditors, be relegated and under EFL control for two more years but at least move on.  He won't let us because he doesn't like Mel Morris and wants to see Mel Morris suffer. And that is it pure and simple, and that is why he is, whatever your protestations to the contrary, the villain of this piece.  It's time for him to show some leadership, move on and concentrate on his own club.

Fine take it to the high court and get it resolved. The EFL have made their position quite clear in that statemement and cannot be trusted to be impartial in this matter.
Get the claims thrown out and then counter sue.
In the unlikely event that the courts find against us i'd rather we just liquidate the club and pay the parasites nothing.

I didn't make the march, but thanks to all those who attended, whether marching or supporting the marchers. You did the club, City, County and DCFC fans worldwide proud.
It was good to see the stadium full again. I hope those extra 7-8,000 fans come back for the remaining games : you can really help to keep the lights on until a buyer can be confirmed.
I guess we all knew that a full house would bring back a few fans who haven't got the memo yet : I won't single out any of the newbies sat near me yesterday for specific criticism, I'll simply say - Please don't let your frustration at poor team and individual performances dampen the positive mood and attitude amongst the majority of the crowd : bite your lips, give encouragement, not abuse, and try and be a bit more tolerant of both the players (who are unquestionably giving 100% for the cause) and your fellow supporters, particularly if you haven't been a regular attender this season, for whatever reason. The club needs both your money and your positivity right now - please give generously of both. UTR

IMO this is part of the EFL/Boro campaign over the last few days to shift the spotlight away from them and onto Morris. We all know that Morris ducked up big time and it will be a very long time (if ever) before he's forgiven for that, but it doesn't change the fact that EFL and Boro are actively twisting the knife and we should do everything we can to keep the spotlight on them for their incompetent/malicious behaviour.
