    Unlucky chaps. I thought we were the better side and deserving of the win, but another day you might nick a draw there. 
    I thought you were dead and buried before Xmas but 50/50 over whether you'll beat the drop or not.
    Much more deserving than Reading, Barnley or PBoro. Long while to go yet.

    Unfortunately I'm not sure this is the smoking gun some of you think it is. Under that rule, *if* we were to lose an arbitration, there's no doubt in my mind that the money would be classed as a football creditor. The rule is just a list of which entities count as football creditors, it makes no real attempt to classify different types of debts or anything, it simply says that all money owed to other clubs is a football creditor debt, full stop.  The fact that the amount owing is as yet unresolved (and may well be zero) doesn't change the fact we would owe it.
    The way to attack their claims are their rights to bring them in the first place, covering the illegality of taking action against clubs in admin, the fact 'Boro's claim has already been looked at and basically kicked out, the fact they're trying to re-run EFL disciplinary cases because they didn't agree with the outcomes, and probably plenty of other things too.
    And if it does come to an actual hearing, we have precedent on our side anyway:

    Never forget their statement after we got the £100k fine.
    When they were "disappointed" at the outcome and "regrettably" could find no grounds to appeal it.
    That would be after going through their own disciplinary processes, the processes that are written in the rules, the processes we are all supposed to have faith in coming to the correct conclusion, they still weren’t happy at the outcome and wished they could find a way to punish us further as they didn’t think it was enough.
    Well, well done EFL, you found a way.
    What an absolute disgrace.

    So, from what I understand, the 2 "aggrieved" clubs can't sue us because we're in administration. The EFL's rules don't allow a club to sue another club, they have to take them to an independent tribunal.
    So where has our current predicament come from? I would hope that the administrators have at some point asked for the 2 clubs to at least apply for an independent panel hearing to take place, thus signalling that their intention is to actively seek compensation. I can understand their legal process towards the merits of the claims, but the claims don't mean anything if they're not officially made. Here is where the EFL should have stepped in. Insist on an official claim within a certain timeframe or dismiss any future claims. This may not be in their remit normally, but we are looking at extreme circumstances. Surely extreme circumstances require some kind of guidance from the ONLY (non)governing body able to do so?
    I have very little faith in any independent panel set up by the EFL. They have shown that they will keep setting up different independent panels until they get the result that they desire. Quantuma should take some flack I believe for the way this particular problem has been handled, but the EFL for me are showing their bias and allowing this whole affair to drag on to get the result they hoped for 2 years ago.

    Correct, so they should take their claim to the League Arbitration Panel.
    If I thought someone owed me £45m I would be trying every channel possible to get my claim ratified as legitimate. 
    Neither has any intention of doing so.

    Hello all, I used to frequent these hallowed pages until 2017 when I thought I'd have a little break.
    I've read the various threads most days, but the longer I went without posting, the more difficult it became to break the ice and make a comeback.
    Fast forward to now and I'm in a position where I'm going to have to be off work for the foreseeable future, home alone during the weekdays, in or at hospital on a regular basis so I figured regular interaction with fellow rams may just be the tonic I need.
    Feels good to be back, even in such dark times for our beloved club.

    It's just the ultimate cop out isn't it?
    It's not our fault, we're just following our guidelines. Yes, we know our guidelines aren't fit for purpose, we know they're outdated and barely worth the paper they're written on. Yes we know that these claims against you hold no legal weight, we know that the claims against you are an unprecedented abuse of the system but they're not covered by our guidelines so um actually scrap that, we don't know anything about them, we haven't even looked at them (honest!) so we can't act on them.
    You deal with it, we insist. No really, we insist. Or else. Yes we know we don't actually have any legal right to insist, but so what? Not our problem.
    What's that you say? The requirement to use a straight line amortisation method isn't stated in our guidelines? And using our own logic that things outside of our guidelines are nothing to do with us, that would mean we can't act against someone for using a different method? But haven't we just spent 2 years exacting punishment after punishment against a club because they used a errrrm, eeeerrrrm, errrrrm, errrrrrrrrrrrrm.... look over there, a three-headed monkey!
